Kavanaugh Joins Liberals To Protect Pro-Planned Parenthood Ruling

DC: The Supreme Court declined to review three cases relating to Republican efforts to defund Planned Parenthood at the state level Monday, over a vigorous dissent from Justice Clarence Thomas.

The dissent was significant because it indicates that Justice Brett Kavanaugh sided with the high court’s liberal wing to deny review of a lower court decision that favored the nation’s largest abortion provider.

“So what explains the Court’s refusal to do its job here?,” Thomas wrote. “I suspect it has something to do with the fact that some respondents in these cases are named ‘Planned Parenthood.’”

“Some tenuous connection to a politically fraught issue does not justify abdicating our judicial duty,” Thomas added. “If anything, neutrally applying the law is all the more important when political issues are in the background.”

Justices Samuel Alito and Neil Gorsuch joined the Thomas dissent, meaning there were three votes in favor of taking the case. Since four votes are needed for the Supreme Court to take up a case, the opinion indicates that Chief Justice John Roberts and Kavanaugh joined with the four liberals to deny review.

This move could indicate that Roberts and Kavanaugh are loath to take take up an abortion-related question in the aftermath of Kavanaugh’s contentious confirmation. The Court’s new junior justice has generally kept a low profile since taking the bench in October.  more here

  2. Surprise! He came highly recommended by everyone affiliated to Bush. Plus he doesn’t really see a problem with the Patriot Act. He probably doesn’t want to hear from the pussy hats this early. LOL.

  3. We don’t want any party affiliation. We want justice under the law, and Gorsuch’s dissenting opinion is a fair and equal interpretation uncolored by the fear of political fallout.

    Good Originalists had Kavanaugh’s back and now he’s turned his on us. Shame.

  4. Give him a break. Has to sit near RBG in the near waff section. If only term limits respected deserved human decently, this would not be an issue.

  5. I don’t blame Kavanaugh for doing this. The GOP had two years to defund PP, and they didn’t do jack motherfucking shit… as usual. It’s the House’s job to remove this funding; not the SCOTUS.

  6. OK, that’s it! My instincts were right. I called out Kavanagh as a RINO as soon as I saw his bio. Some advised me to be patient, a stronger conservative Supreme Court candidate will be in place when Ruthie kicks the bucket. It was suggested just be satisfied to potentially have another “conservative” on the bench.

    Well, Kavanagh has turned out to be Roberts clone. We’re in deep folks and from now on, I’m staying with my first impression which hasn’t failed me yet.

    Lesson: do not make mere flesh your hope. You will be disappointed every single time.

    His record showed that while was he more fiscally conservative, he also never tried to change laws or rock the boat.
    He’s a coaster, but at least he isn’t an activist like Sotomyer or whatever.

  9. WRONG: the Supreme Court just sent it back down to the Appellant level so the case can be judged, and *then* either side can take that lower court verdict back to the Supreme Court to decide.

    The courts have no authority to “defund” PP – they have only the authority to stop the expropriation of the taxpayers to finance the murder of the innocents – and they rejected this. To force a man to pay for that which he opposes on moral grounds is tyranny – plain and simple.
    Kavanaugh learned his lesson. The SC is corrupt beyond retrieval.
