Supreme Court Chief Justice Roberts indefinitely blocked a court order requiring the return of alleged MS-13 gang member Kilmar Abrego Garcia by midnight tonight.

Earlier Monday, President Trump asked the US Supreme Court to intervene and grant an emergency stay of the judge’s order to return alleged MS-13 gang member Abrego Garcia to the United States.

Roberts granted the Trump Administration a stay on Judge Xinis’ order pending resolution.

Lawyers for Abrego Garcia have until Tuesday, April 8 to respond. more

  1. Lieutenant Dike of the Supreme Court must have finally felt a little shameful? I don’t expect it will last. In fact, he’s just waiting until tomorrow to change his mind.

  2. A “stay pending resolution” is a signal indicating that Trump will probably win. A “probability of prevailing on the merits” is a factor in deciding any type of pre-trial injunctive relief or a stay of enforcement of a temporary restraining order.

Of course the opposition – people who want a MS-13 gang member returned – has not presented its full legal position yet. But this seems to involve a purely legal argument so playing on the emotions of the court should be minimal.

  3. Just as auditing USAID and other fed orgs; and just as Democrats have fully tipped their Leftist hand, this administration has laid bare the overreach and unconstitutional tyranny of the third branch of our gov’t. Any reverence that remained for any of our institutions has been withdrawn until further notice. The Judicial branch is also — and always should be — regarded as political. We should never have allowed the wearing of black robes be some outward show of truthful purity; any more than the Pharisees of Jerusalem. Our Founders not only knew of this peril, many warned against it.

God bless and protect this administration. Amen.

  4. Should be a fascinating legal argument by Judge Xerxes since Abrego Garcia was…

    1) in the country illegally.
    2) a member of MS-13.
    3) a convicted felon in the US.
