Texas Judge Rules Obamacare Unconstitutional

Breitbart:

A Texas federal judge on Friday ruled that Obamacare violated the Constitution, likely pushing the ruling towards the Fifth Circuit Court of Appeals.

Judge Reed O’Connor, a U.S. District Judge for the Northern District of Texas appointed by former President George W. Bush, ruled that Obamacare violated the Constitution.

Twenty Republican state attorneys general brought the suit, Texas v. Azar, who asked the court to rule that the Affordable Care Act (ACA) violates the Constitution after Republicans managed to zero out Obamacare’s individual mandate penalty with the Tax Cuts and Jobs Act last year. The judge ruled that the law’s individual mandate violates the Constitution and therefore the entire ACA violates the Constitution. MORE

  1. (Cue Joe Biden): This is a BFD!

It will be entertaining to see how the pols and bureaucrats cut through one of the biggest rat’s nests of red tape ever created.

  2. It’s about time someone took the bull by the horns. This shite called AHA must be buried. Thanks to the likes of that dead splat McStain and Roberts, it lives on today. Anytime someone asks me about it, I ask them why if it is so great didn’t the federal government employees all participate in it? Instead, they exempted their staffers from having to participate as well.

  3. Incredibly, if memory serves, there is no Severability Clause in ACA, which is unusual, so if 1 provision is struck down, the whole thing goes.

  4. Obumblercare was designed to fail, so that we would end up with a single payer, government run health care system. Chief Justice Roberts forced this disaster on us, and now he will get to revisit his chief catastrophe. This is going to be a mighty interesting trip to the Supreme Court. Thankfully, we won’t have to depend on Roberts to decide this case. Thank you, President Trump for your two Supreme Court appointments.
    MAGA!

I do believe you’re right, but I’m not sure that applies here. My preliminary reading of today’s decision left me with the understanding that after Congress removed the individual mandate, which was the basis for the Roberts court finding ACA constitutional strictly speaking because the mandate was a tax and thus within the authorized powers of Congress, that the remaining parts of the ACA no longer had that protection. Without the mandate, there’s no tax. Without the tax, there’s no congressional authorization.

I emphasize that I’ve only read a bit so far, so I could be mistaken.

  7. Just a drop in the ocean. This isn’t going to kill the moving of millions of people onto Medicaid in order to make Obamacare “work.” Government involvement in our healthcare is is still a huge albatross around our necks…

  8. This isn’t going to kill the moving of millions of people onto Medicaid in order to make Obamacare (‘Obamacare’ puppet boy speak for vote for Democrats only) “work.”
Very true since the unconstitutional introduction of this farce for votes. Be nice to know how many not deemed or legally vetted US Citizens for Medicaid/Care have died since the way it was written (not the way it’s been reported by the MSM) that only applies to “Legal Taxpaying US citizens”.
Agree with the “albatross around our necks” take. The real “albatross” in my view is No voter ID required and in today’s abilities to be able to have enforced voter fraud. Gee, I can get turned down for a credit card in seconds, yet non-legal US citizen votes get verified before the final tally.
Still a Lotta work to do, hopefully this is a start,,,

  9. Make sure I got this right:

Anytime the Pres tries to fix our illegal immigration problem, one Obama or Clinton judge can derail the whole thing until it goes to the Supreme Court.

But this judge rules against Obamacare so everybody needs to keep signing up as newspapers, TV and everyone else keeps giving free advertisements for people to enroll before the deadline.

  10. Cliche, yep, you got it, spot on!
As long as judges are appointed for life, instead of meeting unfortunate car accidents, that’s what we are left with. Or offending a Clinton which usually results in a suicide from having 2 head shots from their 4′ foot long arms in public.

  11. Now the Left is going to run ads that literally state all Rs want to kill you because they don’t want you to have government run healthcare. I don’t mean campaign ads either, I mean round the clock TV ads.

    4
  12. grool, been seeing the same ads for decades. Originally the ads from the Left were about killing your unborn grandchildren. Since than, just trickle down economics bringing us now to their choice after stealing all they have been legally creating laws to take from you is “Do you want to live” or otherwise we need to decide to steal more from you for our grandchildren?
See how they always know better?
    It never ends,,,

  13. TO blink
That’s because this Judge, unlike Roberts, doesn’t have 2 adopted kids that can be taken from him as blackmail/”leverage”.

  14. There’s a judge somewhere, who can read?
    Color me shocked!

Now, is there an AG somewhere who knows the definitions of “Treason” and “Conspiracy to Defraud” and is willing to take on Gruber, Reid, Obola, and Pelosi?

    I know … I know …

    izlamo delenda est …

  15. Also, origination. Because Ted Kennedy had did, dems did not have the votes to approve the House bill. So, under reconciliation, they allowed the House to pass the Senate bill. If, it was a tax,as defined by Roberts, that was unconstitutional as tax bills have to originate in the House.
Therefore, Roberts opinion itself was based upon a lie.

I wonder if Barry O will take credit when the free market actually makes health insurance and health care affordable again, after Ocare is struck down.
