Is there a kind of “sex” that’s not “biological”? No. “Sex” is a reproductive role, and there are only two. (No one will be confused in context that you might be referring to an activity.)
“Biological sex” is a redundancy. (No one will be confused in context wondering if you meant wild sex, dirty sex, make-up sex, kinky sex, or whatever.)

Sadly, if this went before the SCOTUS, it’s a certainty that 3 women justices would vote to erase their own sex from legal recognition with a 50/50 chance of all 4 women justices voting to erase it.
