Alabama Supreme Court Overturns State Open Carry Ban

BearingArms: On Friday the Alabama Supreme Court struck down a state law that banned open carry on someone else’s property.

The Alabama Supreme Court on Friday ruled a state law that banned the open carry of a gun on someone else’s property is unconstitutional.

Friday’s ruling by the court came in an appeal by Jason Dean Tulley, 38, of his Jacksonville city court conviction for openly carrying a pistol on his hip while inside the First Educators Credit Union on March 31, 2011.

An off-duty police officer working security at the credit union told Tulley to leave the credit union and put the gun in his car. Tulley, who at the time also had a conceal carry permit, argued his rights but eventually complied. Tulley was charged days later.  MORE

  1. I don’t believe that open carry has the same effect as concealed carry on crime. If the criminal has no idea whether or not the person he is going to attack is armed, that is a plus for the any intended victim. See Dr. John Lott’s book, More Guns, Less Crime.

  2. Stranded, I agree and believe you’re on the right track.

    I don’t have a problem with open carry at all. What I have a concern for is those who carry (law enforcement or citizen) that believe that the firearm is the warrior. The firearm is merely a tool of the warrior (or replace “warrior” with non-victim). There is a huge difference between: I’m showing you I’m armed, don’t mess with me, and; Don’t mess with me, you don’t know if I’m armed and capable (demeanor).”

    This is an interesting case since (where I am), if you park in their lot which is public access, you are subject to vehicle code enforcement for an, “off street parking facility.” But your business is open to the public, does that not fit the same intent? Here it comes…. However, it’s private property. Yet the paradox of, open to public access vs private property not open to the public.

    Bottom line (in my opinion) is carry, don’t advertise, and look the dirtbag in the eye with a Clint Eastwood squint that tells the adam henry that you are the warrior and not them. Let them consider their options and their plight. (I could go into war stories but I’ll spare all.)
