CA Judge: Baker has right to refuse ‘same-sex wedding’ cakes

WND: A California judge has refused to advance a social agenda in his state that targets Christians who refuse to endorse homosexuality through their work.

In this case it was baker Cathy Miller of Tastries Bakery who was put in a state bull’s-eye because she refused to use her artistic talents to promote the “wedding” of two lesbians.

The state asked Superior Court Judge David Lampe to issue a preliminary injunction ordering Miller either to create wedding cakes for same-sex duos or be barred from serving anyone.

But Lampe recognized that the issue is not about discrimination against same-sex couples.

“The state is not petitioning the court to order defendants to sell a cake. The state asks this court to compel Miller to use her talents to design and create a cake she has not yet conceived with the knowledge that her work will be displayed in celebration of a marital union her religion forbids. For this court to force such compliance would do violence to the essentials of Free Speech guaranteed under the First Amendment,” he wrote.

The same issue is before the U.S. Supreme Court in a case brought by Colorado against Masterpiece Cakeshop baker Jack Phillips, who refused to make a wedding cake for two homosexuals at a time when same-sex marriage was illegal in the state.  read more

  1. This is one CA judge wanting to be on the right side of a SCOTUS decision.
    Oregon is gonna have egg on its face.
    Denying Constitutional rights, under rule of illegal law in a courtroom, isn’t taken lightly.

  2. I actually always found the objection on religious grounds to be shaky. Why only religious grounds? Doesn’t a business have a right to just say, “Because I don’t feel like it, that’s why.”
    Let’s take the politics out for arguments sake.
    Say you’re a portrait photographer and someone comes to you and says they want a picture of their dog. Don’t you have the right to say, “No, I hate dogs and don’t want to. I didn’t become a photographer to take pictures of dogs.”
    By the same token, what if you’re a “trans” baker in Greenwich Village and all you do is make penis and vagina shaped cookies all day. Then, an NRA member comes in and says, “I’d like an AR-15 shaped cookie, please.”
    Nothing to do with religion and everything to do with running a business your own way. The trans baker would only be guilty of discrimination if they refused to sell a penis cookie to the NRA member.

  3. Finally a judge that gets it. They were not refused a cake sitting in the display or in a catalogue of samples that was being offered, they were refused a product the bakery wasn’t in the business of making. I would compare it to asking a car maker to build something “special” that was not offered in the showroom or sales literature.

    Who owns the business? Why not “We reserve the right to refuse service to anyone, for any reason, or for no reason. If you don’t like it, go elsewhere.”?

    I know a guy in construction who told me that if he didn’t want to do a particular job he just bid excessively high. I questioned the need for subterfuge; until I saw the imbecilities of our “judicial” system in action.

    Opening a business does not make you a slave to every asshole who darkens your door.

  5. For those of you who love to laugh at California you always fail to mention the Perfect state you reside in. Every state has been affected by the leftists takeover of our country. Name your state and I’m sure we can find problems there as well.
    California was a conservative state and so were many other states that have been turned left.
    Maybe it would be wiser to realize that many of us are working very hard to correct the leftist takeover of this state.
    One would think that conservatives from every state would wish each other good luck in their battle against leftists.
