Federal Court Rules Male-Only Draft Is Unconstitutional

Epoch Times: A federal judge ruled that a men-only draft is unconstitutional, but stopped short of ordering the Selective Service to register women for service.

U.S. District Judge Gray Miller of the Southern District of Texas sided with a San Diego-based men’s advocacy group that challenged the federal government having only men sign up to get drafted, reported the San Diego Union-Tribune.

“This case balances on the tension between the constitutionally enshrined power of Congress to raise armies and the constitutional mandate that no person be denied the equal protection of the law,” Gray wrote.

The suit was filed against the Selective Service System by Texas resident James Lesmeister. He later added San Diego resident Anthony Davis and the San Diego-based National Coalition for Men as plaintiffs. Both Lesmeister and Davis were eligible for the draft when the suit was filed.

In 2015, the Pentagon lifted restrictions on women in military service, including combat roles.

Lawyer Marc Angelucci said in a statement that he’s happy with the judge’s decision.  MORE

    We didn’t set the terms of engagement here. They were imposed on us, so we’re sticking to them. Equal is equal, or it isn’t. Pick one.

  4. Why should men be drafted? My body my privacy! Also, why should men be forced to work to support woman and children? My body my privacy! Also, why should men have to labor at all to earn a living? My body my privacy, etc, etc, etc!

    Hold the enemy to his own standard and make him (or her) squeal beneath the weight of it. They taught us that. We need to put it into action every chance we get.

  6. I am extremely glad that both my daughters are a little older now and not of draft age. if you want to piss me off come and try to draft my daughters and you’d find out how angry I am about this. NO DRAFT FOR WOMEN EVER! And as for men only in an absolute emergency like World War 2.

  7. The religion, society, culture, and legal system of our most likely enemy permits and even encourages the rape and sexual slavery of captured women. The fate of female POWs will make that of the imperial Japanese military’s comfort women pale in comparison.

  11. That Judge is a chickenshit (or a Democrat, same thing really). He should have ordered eligible women to report and register for Selective Service. Can you imagine the screaming coming from them when one of the sticks used to beat conservatives (and men) actually becomes true! Tens of thousands of military aged women that call themselves feminists will be screaming at their leaders to stop this and they won’t care that it makes them all look like two faced hypocritical double dealing bitches. Umm, the last part only applies to most of them as I’m sure there are plenty of feminists who actually believe in true, not selective, equality and be honored to register to protect their country.

    Saw an art history show that showed that cultures can go round in cycles. They advance and progress to near perfection, which leads to boredom, turns their interest to the absurd, which trashes the collective intellect, and the cycle reverses.

    Apparently, the early 1970s was the top of the ferris wheel ride. Hopefully we’re swinging low real fast and hard so we can ascend again sooner than later.

  14. This is a screwed-up deal. Selective Service has been around since the 1940’s. Before that, there were Civil War and WWI drafts. Why is it all of a sudden unconstitutional?

    Men turning to pussies….it’s disgusting.

    It’s probably a life saver for us that Russia and/or China would have a heckava time trying to land troops anywhere in North or South America. Our geography may be the only thing we got left to keep us safe.
