Court: Finger Guns Are Illegal In Pennsylvania

We all know that the ridiculous “zero tolerance” policies in our schools gets kindergartners suspended for biting a Pop-Tart in to the shape of a pistol or making a finger gun gesture. Apparently finger guns are a no-no for adults too and are even criminal. A man in Pennsylvania was convicted of pointing his finger gun at a neighbor and the state superior court upheld his conviction saying it represented a credible threat. Everything is now officially stupid.

Fox News reports that 64-year-old Stephen Kirchner was walking in front of his neighbor’s house last year. The two neighbors had previous confrontations but never anything physical. The report is pretty confusing, but the best I can figure is that the neighbor said something and then flipped Kirchner a double-bird. After getting two middle fingers, Kirchner made a finger gun and pretended to shoot the neighbor.

Another neighbor saw this and called the police. I’m not sure why the Manor Township, PA police took this call seriously, but they did and arrested Kirchner. He was eventually convicted of disorderly conduct.

If a finger gun is a shooting threat, why isn’t a middle finger a rape threat? The middle finger means “f*ck you” and the neighbor threw up two of those, so why wasn’t the neighbor also cited for implied sexual assault?

  1. Okay, unless there’s something else here that I’m missing or was NOT reported as part of this, the prize for wasting time and resources should be awarded to these twits.

    How about we form a committee to go down to stand in front of the court house and finger shoot all the people entering and leaving the building.

    Glad I got the edit in on time cause I originally left out the “finger.”

  2. In the days of, “AGGRESSIVE DRIVERS… WE ARE WATCHING YOU!”, even 20 years ago, making the “gun hand” at a motorist, or pedestrian, would get your vehicle searched at the very least.

    Even in MD 20 years ago that was bad shit. Don’t do it.

    It’s absurd, but it’s not a new thing.

  3. Um.. but he used his “ASSAULT” finger and it probably had a 100 round “clip” and I am sure it was fully, semiautomatic….. very dangerous stuff!

  6. Curious if anybody here has had that gesture made towards them? Many years ago I did, with my family in tow. A CJ5 that was tattooing my bumper while I was doing the speed limit. Unfortunately for them there was a red light awaiting them. It turn out well for them. Or for me. Had my wife hanging on me screaming what the F are you doing? I guess I was doing what came natural.Thats a cowardly threatening gesture. Don’t do it.

  7. So finger pointing is a credible threat but emailing classified material to all and sundry lacks intent and is therefore not prosecutable. If I didn’t know better I’d say that there might be a two tiered system based on wealth and connections. Just a guess.
