WFB: A judge struck down Boulder, Colorado’s ban on the possession of AR-15s and magazines holding more than 10 rounds on Monday.
Colorado state judge Andrew Hartman ruled the city’s gun ban violated the state’s preemption law, which prevents localities from imposing gun regulations above and beyond state law. Judge Hartman’s ruling declares the ordinance invalid and immediately bars the city from enforcing the ban.
“The Court has determined that only Colorado state (or federal) law can prohibit the possession, sale, and transfer of assault weapons and large capacity magazines,” Hartman wrote in the ruling.
The ruling is the latest in a string of victories for gun advocates who have used state preemption laws to overturn strict local gun regulations. A Washington court struck down a local ordinance on gun storage in February 2021, and a Pennsylvania court struck down Pittsburgh’s attempt to regulate the use of AR-15s inside city limits in October 2019.
Jon Caldara, a longtime Boulder resident who openly flouted the AR-15 ban, said he was “thrilled” by the ruling. The former Denver Post columnist and Independence Institute president publicly announced he would not comply with the order to turn over his AR-15 or ammunition magazines when the ban was instituted in 2019. He filed a separate federal suit against the ordinance and said his family has received backlash from supporters ever since.
“I was probably the most publicly known criminal in Boulder,” he told the Washington Free Beacon. “That made us social outcasts. And it was really bad. My daughter got bullied at school for our position.” read more
Darn straight!
People who like to shoot things have constitutional rights, too.
God bless and protect Patriots like Jon Caldara.
Not good! The judge states that states and the Feds can ban anything they want. The Constitution says otherwise.
We the people won’t be able to take our stolen rights back with BB guns and slingshots.
Funny thing is,they are scared to death of AR style weapons. For their own safety in the long run. That’s not the weapon they should be concerned about. In fact when things go kinetic the AR will be insignificant. For a while anyway.
Not too thrilled with the word “assault” weapon either.
Not gonna mean much with Biden starting the push to ban them completely.
And he is likely to succeed with the backing of the Democrats and some Republicans in both the House and the Senate.
I can finally buy one! My current home town!
Thinking more AR-10 though 🙂
…no matter, cops will seize them anyway, knowing you can’t afford to fight them in court to get them back.
…ask that guy in Montana how THAT works…

I’d question an AR-10 first. But what ever you decide to go with you should just build you own. Not that difficult. All the major manufactures take shorts cuts on some component of the gun. From Barrels to BCGs. I can give you a list of component parts and tell you why they are superior.
@Brad – I will definitely check with you when the time comes.
Not in a rush – although perhaps I should be.

Skip the AR10 and go with an FAL.
You won’t regret it.
They probably will take my constitutional right to bear arms sooner or later but just because they draw a big X thru the 2nd Amendment doesn’t mean I’m going to march down to the capitol and throw my guns over nanzi’s wall.
