It seems pretty simple to me;
If you entered the capital at the behest of guards who encouraged the entry, and left the same way, no crime so no charge. If you assaulted a cop or caused property damage (and there is actual evidence available to prove this) then you should be charged with a crime.
And if you were a cop present who discharged a firearm without sufficient cause, you get charged with attempted murder, no qualified immunity to hide behind.
