A Supreme Crackdown on the Environmental Protection Agency?

The Supreme Court may be on the verge of clawing back some of the sweeping regulatory authority it unwisely gave the U.S. Environmental Protection Agency 15 years ago at the height of Al Gore-promoted global warming hysteria.

This about-face by the high court could come if conservative justices have the courage to do the right thing in West Virginia v. EPA, which the court heard Feb. 28. In all, 19 states are challenging how much power the federal Clean Air Act gives the agency.

West Virginia Attorney General Patrick Morrisey, a Republican leading the legal challenge, told this writer recently he is concerned the EPA is transforming itself from “an environmental regulator into a central energy planning authority.” more

  1. If SCOTUS insists on Rule By Law(TM), instead of regime by regulation… maybe they should shut it all down, until a statutory budget is passed, into law.

    “MAY” That’s certainly a load off my mind. Especially because just last week I received the following notice from the local mini dictators.

    “We have reached the point of no return. It’s game over for your old stoves, so we can restore clean air to the Fairbanks North Star Borough! All solid fuel fired heating devices [wood/pellet/coal stoves] in the borough nonattainment area must comply with air quality regulations.
    Devices 25 years-old and older [EPA and non-EPA certified] and all coal and barrel stoves must be removed or replaced by December 2024. Remove these now if you sell or lease your home.”

    Now I can understand their concern. It’s a fairly warm day and I barely have the woodstove going and I can only see about twenty-five miles. Imagine what its like when it’s 40 below and everyone in the neighborhood has every heating device they own going full blast. Visibility is cut to about twenty-five miles. I’m sure glad there’s people out there working tirelessly to clean my air.
