While the current election is justifiably dominating the news, Daniel Penny’s trial for allegedly killing Jordan Neely on a New York City subway has begun, and a new revelation has turned the prosecution on its head.
As RedState reported, Penny initially subdued Neely after the latter began to act erratically, including lunging at and threatening women and children on the train. Neely would go on to perish and Penny was arrested and charged with manslaughter by infamous Manhattan DA Alvin Bragg.
At the time, the facts of the case were already called into question after a video taken on the scene showed Neely still breathing for a significant period after the altercation. Further, Penny put Neely in the “recovery position,” suggesting he had no intent to cause permanent harm. At the time, I asked whether Neely was still breathing when first responders arrived. more
Penny is a hero. The left destroys heroes.
Trail is in Manhattan logic and reason have at best a 50 50 chance.
Stay out of New York.
“Among witnesses on the first day of evidence was an NYPD Sergeant who testified that none of his team performed mouth-to-mouth on Neely because he was a ‘drug user’.
‘He seemed to be a drug user.. he was an apparent drug user. He was very dirty. I didn’t want them to get… hepatitis.
‘If he did wake up he would have been vomiting. I didn’t want my officers to do that.
‘He was filthy. He looked like a homeless individual. You have to protect your officer.
‘I wouldn’t want my officer to get sick if the person throws up,’ he said. ”

…as I said in a previous thread, I do NOT fault them for giving Narcan first. Narcan in one form or another IS in most state’s protocols as a standard administrate for ANY “Unknown Down” REGARDLESS of whether he “looks” like a drug user or not. Clean suburban teens do drugs, unknowing girls get slipped a Mickey, grandparents forget if they took their pain medicine and take it again, small children find Grandma’s colorful little candies… no, its not ‘judgemental’ NOR is it inapproprate to dose EVERYONE found down with Narcan, it may help and it cant hurt. I’m carrying some right now in my belt-worn medkit I use in my current First Responder role. An unconsious person gets it in most situations and from most agencies.
Followed by immediate CPR in nonbreathers.
FOLLOWED by IMMEDIATE CPR.
That second part is IMPORTANT.
…Naloxone is fine as far as it goes, but it cant alleviate respiratory depression stuck up a nose or pooling in cooling flesh. It needs SOME semblance of circulation to work.
…and if youre a cop or a medic, providing that is your DUTY.
…I typically used a Bag Valve Mask on the Little Red Truck, it does insulate you from the gooshy stuff, lets you SEE how your inflation is going, and can provide high oxygen with a hose connected. You can even plug them into an ET tube when one is passed. People CAN and DO vomit when an untubed patient is inflated because air goes in the stomach, and this keeps you where you can see it coming and react too. If you have access to one (and the NYPD probably carry them) theyre great. Back in the Clinton years MY cops carried airway bags because they usually got in ahead of us, if they could do it THEN they can do it NOW.
But even if you have them, they dont solve ALL your problems.
I had a febrile baby that shut down on us once, and the tiny BVM and small enough masks werent small enough. Not being named Harris I am opposed to babies dying, especially when its my DUTY to keep that from happening, so it was mouth-to-mouth and nose time. The kid urped in my mouth (not a lot of solids at that age, thankfully), so spit it out, bulb suction him, then back to it. Got to ROSC as we hit the bay, so that one was a win.
…but there are OTHER options as well. Nowadays they have a variety of barrier masks to choose from for the occasional rescuer, from ones that are standard nose-and-mouth pillow seals to flattish pieces of vinyl, all with one-way valves to catch puke, some fit in keychain pouches, and some so cheap they include them with your CPR class. No reason a LEO shouldnt have one.
…but again, crap happens.
After my company added their responder program, I carried a mask in a shell for a time, but years went by and it was just kind of bulky when getting into machine spaces, so I stopped carrying it for a time.
Then enter Coof and the fake vaxxxine, and now Ive got a 19 yo nonbreather collapsed in the toilet. So what to do?
…well, for the second time in my life, unprotected rescue breathing. Didnt help, the kid died anyway, but I wouldnt have been able to look at my co-workers, his grandma, my family, or even at myself in the mirror if I hadnt at least TRIED.
And I CERTAINLY wouldnt want to face God with a shrug and a bunch of excuses.
Happily he didnt barf, but that waz kind of the least of his worries (and mine) by then.
…funny story, since I used a mask most every other time I forgot to pinch his nose closed, getting reminded when my breath blew through him back onto my cheek. Also, when I was joined by my EHS guy with the AED, he was new at this so he looked SO hopeful when I backed off and the kid made a vocalization from the escaping air, I kinda felt bad to tell him what it was, but I did have other things going on at the time so couldnt worry about feelz. Fortunately he was the step-up type which was good when we had to bring back the Fentanyl kid in the smoking shelter a month or so later, but different story for another day.
…but you know what?
THERE IS ALSO A HANDS-ONLY CPR PROTOCOL FOR THE SQUEAMISH!
…yes, they could have simply done chest compressions ONLY and at LEAST gave the guy (and Mr. Penny) a CHANCE, but noooo, too dirty, so we decide which lives are worth saving by cleanliness level or sumpin, I guess.
Good luck explaining THAT to the Lord.
…at the end of the day, it is true that you cant FORCE a guy to do something that may injure or kill him, and yes, druggies may have diseases and/or Fentanyl om their lips.
But its just the CONSTANT cowardice I keep reading about with the kids on all levels, from the beat cop to the Chief of Surgery at the hospital that browns me.
If you dont want to occasionally risk your life, fine.
Just dont EVER put on a badge that falsely tells people that you DO accept an occasional risk then, youre just lying to everyone including yourself otherwise…
