Cohen Lawyers Move To Boot Michael Avenatti From NY Case For Unethical, Reckless Actions

Daily Caller: Attorneys representing embattled Trump fixer Michael Cohen asked a federal court in New York to deny Michael Avenatti’s request to appear and represent Stormy Daniels in an ongoing dispute over the April 9 search of Cohen’s office.

Avenatti, who is not licensed to practice law in New York, is seeking the court’s permission to appear on Daniels’ behalf in the Cohen case. Cohen lawyers argued Friday the request should be denied.

“The ongoing inaccurate statements started the very day Mr. Avenatti announced at a press conference his representation of Ms. Clifford,” the filing reads. “Since then, he has made numerous claims against Mr. Cohen that lack accuracy and factual support. Mr. Avenatti appears to be primarily focused on smearing Mr. Cohen publicly in his efforts to further his own interest in garnering as much media attention as possible.”

Rule 3.6 of the New York Rules of Professional Conduct provides that attorneys should not make out of court statements which could prejudice a pending matter. Cohen’s lawyers say Avenatti has violated the rule by disseminating false information he may have obtained unlawfully about Cohen’s finances. Avenatti released intimate details of Cohen’s personal financial history early in May, though the data he disclosed compromised other individuals of the same name not related to the investigation.  more here

Avenatti on Monday missed a scheduled $2 million payment to a former law partner, Jason Frank, according to a lawsuit Frank filed in court Wednesday. The missed payment was first reported by The Los Angeles Times on Thursday. Avenatti had personally guaranteed the $2 million payment as the first installment of a $4.85 million settlement with Frank. An arbitration panel found in February 2017 that Avenatti’s law firm had “acted with malice, oppression and fraud” and improperly withheld millions of dollars owed to Frank, the Times reported. “Avenatti has no valid excuse for failing to perform this obligation,” according to Frank’s lawsuit.

  1. why bother? Avenatti doesn’t really want to go to trial … if that happened he would have to hire real lawyers to argue the case

… of which there is none

just a lot of media whoring by a whore ‘lawyer’ for a whore ‘client’

  2. He EMBEZZLED $5 million in escrowed employee taxes, work comp and SocSec withholdings, and other monies belonging to the IRS, SSA & various state tax authorities.

In his December 2017 bankruptcy filing he swore under oath he was worth only $400k.

Someone’s looking at some serious prison time. Avenatti is the dancing organ grinder monkey for whatever DNC/ Clinton middleman is keeping him in lunch and rent money while his smear campaign shtick grows stale.
Avenatti naturally plans to abandon Daniels, but the Dems may abandon Avenatti first.

  3. Avenatti reminds me of the Joe Pesci character in CASINO.

Loudmouthed, brash, dumb enough to think he’s got tiger blood, too dumb to survive.

He’s got “shallow grave in the cornfield” written all over him.

  4. I guess there “Law Right”, and then there’s “Man Right”. When shit deteriorates Man Right is the law of the land. I don’t think assholes like him have prepared for that eventuality. I don’t see it’s avoidable.

  5. Come on now….
Despite ALL the bad press and factual reports of his embezzling money, owing the IRS, and screwing over the people that trusted him he still retained his license to practice law.
In fact he is SOOO good as a lawyer that someone paid him $8,000,000 the day before he took on the hooker case so he must be good for something other than criminal conduct, right?

I mean at the very least he qualifies for public office as a democrat!
