Colorado’s 3-Day Waiting Period Challenged

JTN: The day after a Colorado law established a waiting period for a firearms seller to deliver a gun to a purchaser, it’s being challenged in court.

House Bill 23-1912, signed into law by Democratic Gov. Jared Polis and taking effect on Oct. 1, established a three-day waiting period for the seller to deliver the firearm to the purchaser. “The waiting period is the later in time of three days after the initiation of a required background check of the purchaser or when the purchase is approved following any background check,” the bill’s summary states.

The Rocky Mountain Gun Owners and Alicia Garcia, a firearms instructor, filed a 36-page civil lawsuit in U.S. District Court in Colorado against Polis. The suit argues the law violates the Second Amendment of the U.S. Constitution by imposing unnecessary and burdensome delays on law-abiding citizens seeking to exercise their right to bear arms. more

    However, I have a question about the wording of the law: the waiting period starts upon the initiation of the background check or after the background check is successfully completed? There is a way for the background check to begin before it is initiated? How does that work? How could three days after the initiation of the background check be later than three days after the background check is completed?

Proposed 28th Amendment: The waiting period in each State for each purchase of a 2nd Amendment weapon shall be the same as the waiting period for an abortion in said State; unless abortion is disallowed in said state, in which case said State will maintain a pile’o’weaponry from which citizens shall take annually at no cost.

  3. How about drug, needle, & pot dispensaries in Colorado require a three-day waiting period as well?
    Asian women should have to wait three days before a driver’s license is issued.
    Blacks should have to wait outside a Target or Walgreens for three-day to reduce shoplifting…

  4. @RadioMattM — My guess about the law’s screwy wording is that the person who actually wrote it went to public schools and got a law degree via a correspondence course run out of Romania. All the people who were supposed to have edited and OKed it were too busy screwing the pages, aids, paralegals, and their colleagues wives and daughters and husbands and sons and partners and gardeners. And dogs.

    Just like in Illinois, a waiting period is just a mechanism to prevent yourself from being protected from an a$$hole who is wielding a stolen gun.
