DC: The U.S. Court of Appeals for the D.C. Circuit has found that a former Guantanamo Bay detainee cannot sue for damages for his subjection to enhanced interrogation techniques.
Mohamed Jawad of Pakistan filed a lawsuit in U.S. court seeking to recover damages for torture during his six-year detention at Guantanamo Bay. A three judge panel ruled that a 2006 law forbids federal courts from hearing such cases.
“By its clear terms, this provision strips federal courts of jurisdiction to hear most claims against the United States arising out of the detention of aliens like Jawad captured during the United States’ invasion of Afghanistan in response to the attacks of September 11, 2001,” wrote Judge Thomas Griffith. How about those Supreme COurt appointments now? This case will go to SCOTUS. Right now, at best, any decision would be a four – four split. So who gets to chose vote five? WHen the case is decided by the court, a couple or few years from now, the appointees of the next administration will decide.
SCOTUS appointments are anything but a side-issue. Review the last eight years of appointments and resulting Court decisions. The next appointments trump all other issues, in my mind, in this race. Almost anything else a president or congress does can be overturned by SCOTUS.
It might be too late to affect my childrens’ lives, but my grandchildren will be living in either Clinton or Trump appointee world.
