England: Woman with birth defect sues mom’s doc for ‘wrongful conception’, claims she shouldn’t have been born

An English woman with spina bifida is suing her mother’s former doctor, claiming his negligence resulted in her birth defect and that she never should have been born.

Evie Toombes, 20, of Lincolnshire, is suing Dr. Philip Mitchell for “wrongful conception,” alleging that he failed to advise her mother to take folic acid supplements prior to pregnancy resulting in her birth defect, according to The Telegraph.

Toombes was diagnosed with lipomyelomeningocele after her birth in November 2001, a neural tube defect to the spine that inhibited the normal development of bones along her spinal cord, resulting in permanent disability.

She claims her mother would not have had her if she knew that she needed to take folic acid supplements to mitigate against the risk of her baby developing the defect. read more

I know full well how expensive it is to keep horses, let alone to fund high level equestrian sports so that grifting mother can’t tell me she couldn’t buy a book or get one from the library or search a valid website for prenatal information?! That’s what I did, though I had a great doctor. Besides, I didn’t wait until I was 50. That just increases the chances of something going wrong.

  4. Not all cases of Spina Bifida are from the mother not getting enough Folic Acid, or a bad diet.

    My niece took prenatal supplements for all of her four children. The first three were born perfectly healthy. The fourth one was diagnosed with spina bifida mid-way through her pregnancy. The doctors tried to pressure her to have an abortion. She and her husband refused.

    The child has been through many surgeries, but is a strong willed person who needs to walk with braces. What a kind and loving teenager now; much beloved and happy.

  5. There’s already precedent for this. An Indian guy tried to sue his parents for support, saying that they owed it to him by forcing him to exist. They successfully countersued saying that the sperm that he used to be won the competition to fertilize the egg.

    If this chick is really that unhappy about her existence, then she’s free to do something about it. No one will try to stop her.
