Federal Appeals Court Upholds Tennessee Law, Says There Is No Right To Change Sex On Birth Certificate

A federal appeals court on Friday sided with Tennessee, finding that its law saying transgender-indentifying individuals cannot change their sex on their birth certificates does not run afoul of the Constitution.

In a 2-1 decision, the Sixth Circuit Court of Appeals ruled that Tennessee statute saying that birth certificates need to line up with sex does not violate the 14th Amendment. The state was sued by four men who identify as women who wanted to change the sex on their Tennessee birth certificates to female. 

“But absent an existing fundamental right, the Constitution does not require the States to embrace the plaintiffs’ view of what information a birth certificate must record,” wrote Judge Jeffrey Sutton. “That’s why Tennessee’s choice to record sex — not gender identity — does not withhold a constitutionally prescribed benefit. Its amendment policy treats both sexes equally, and as elaborated below there is no fundamental right to a birth certificate recording gender identity instead of biological sex.” more

    It’s proof again just how screwed the leftists are and the fact that they will go to any extreme to confuse, misguide and deflect normal humane standards in order to obstruct the truth and hopefully advance their own agenda.

  2. I have seen estimates from .5% to 1% of people identify as transgender – and I think that this is too high. Anecdotally, I have known thousands of people in my life (including living in Southern California for 40 years), and the number of those I know identifying as transgender is 0%. The number of people wanting to go to court to change their birth certificate that I know if is 1. (See Lodi v. Lodi, 173 Cal.App.3d 629 where the plaintiff and defendant, who were the same person, sought to impose a charitable trust in or by or maybe even despite his birth certificate. He lost, or he won – depending on your perspective). Anyway, I am aware of one more person who wanted to change or revoke his birth certificate than who publically admit they are transgender.

    I don’t know why we allow the court system to be used for these purposes. If a dude believes he is a woman, or even if he just wants to prance around in woman’s clothing and claim he is transgender, just go for it. If you want a medical professional (or an auto mechanic for all I care) to mutilate your body to satisfy your delusions, feel free. Just don’t waste everyone else’s time or government money arguing you should be allowed to change your birth certificate – it doesn’t make any difference and no one else cares.
