WaExaminer: Imagine you’re a small business, and one day you are sued because a posted handicapped parking sign in your parking lot is only 59 inches off the ground, and not 60.
You can spend tens of thousands of dollars to fight the suit over several months, or, you can settle for less. It may sound ridiculous, but the law is the law. And for some, it’s an opportunity to collect some cash.
Last year an advocacy group in Phoenix filed over 1,000 lawsuits against businesses for violating requirements of the Americans with Disabilities Act, or ADA. In many instances, the plaintiffs demanded thousands of dollars for a settlement over the slightest of technicalities, many of which could be remedied quickly. But remedy was seldom an option. According to TV station ABC-15, which broke this particular story, the charity was assisted by a handicapped individual who acted as the plaintiff on most of the suits, even though the person had not physically been to a number of the properties that were eventually sued.
In Florida, an investigative reporting team discovered a man who had filed over 1,000 ADA lawsuits, one of them even alleging that a business had a toilet paper dispenser that wasn’t the right height.
Stories similar to this have sprouted up across the country, and lawmakers have taken notice.
“advocacy group” = agitators
Bet the signs were 60 inches off the ground before the parking lot was resurfaced adding the additional inch.
You could argue the tolerance for integer values is 5%.
I would argue the plaintiff is a royal asshole grupping for money and be satisfied with being held in contempt of court.
Then I would invite said asshole back to my establishment just to deny him service. NO Soup For You.
“Handicapped individual”?
What handicapped individual?
Case dismissed on failure to
appear.
I contend the plaintiff is a believer in ‘common core’ and not common sense.
Fuck the liberal fuckers.
This has grown from a cottage industry 15 years ago to a major get rich quick scheme. My last two employers have been sued over and over by these fanatics. It’s not about access, it’s about getting wealthy. As soon as I open a new facility they swoop in with tape measures and lawyers. It is driving costs thru roof and making it really difficult to find a urinal for my height.
I forget the name, this was over 4 years ago, but it’s the same fat-fucked a-hole advocating and suing in the name of the ADA in thousands of lawsuits. (Sorta like that fat nemesis in episodes of Monk years ago on TV). He’s a POS. Trump needs to…neutralize…this wonder of nature.
Nothing but a “shake down” artists…..
going around with tape measure in hand looking for businesses to sue for a payday…..
not looking to buy anything…..just looking for minor noncompliance items so they can sue and collect…..
despicable people.
A few pops with a riot baton? They won’t come
back.Trust me.
Sad to be disabled, but when a law is used to try an extort money from a business is wrong. Do I need a sign for my house that says “this house may not be handicapped ready?” There are always scammers out there.
