Hiding crime? Hochul signs bill sealing New York criminal records

JTN: More than 2 billion criminal records could be sealed under a bill signed into law by New York Gov. Kathy Hochul, which is expected to add to Republican claims that the state’s Democrats are too soft on crime.

The “clean slate” law, which goes into effect in one year, will allow ex-cons who’ve completed their sentences, parole, or probation to get criminal records sealed three years after they are sentenced for misdemeanors and seven years for felonies, so long as they haven’t been convicted of other offenses.

Sex crimes and major felonies, such as murder, will not be eligible for sealing, according to the Hochul administration. more here

  1. Newsom’s like damn, why didn’t I think of that. On the first of the year SB2 goes in to effect here in land of the freaks, aka, California. SB2 prohibits ccw’s from carrying in any retail store, any restaurant, any bank. Any parking lot of a bank.
    They copied this bill from New York. Damn near verbatim. New York’s already got shot down by the courts. GOA filed suit before Gavin even signed the bill. The idea that CCW’s are somehow the problem is mind blowing. They’re doing everything they can to release violent criminals back on the streets and at the same time everything they can to disarm us. They clearly want us dead.
    Nobody that carries in California is going to abide by this bullshit. Gavin just made us all criminals. Fucking pansy.

    See, felons aren’t supposed to vote. I wonder if they’ll be able to vote AND LEGALLY BUY FIREARMS ……..

  3. I’m actually a little bit torn on this one. If she were to allow the first, and only the first, conviction (with the same exceptions) to be sealed, I’m willing to give the felon a second chance with a clean slate. Commit another crime, and all bets are off.

    I’m sure I will get ripped a new one for this position, but so be it.

  4. @stirrin the pot — I like the concept but not the way you envision its implementation. How about this: future expunging or sealing or records is part of the convict’s sentence and decided by the convicting jury or judge.

  5. How is this supposed to work with the NICS background check? Where is “Every Town”, and “The Brady Bunch”? I thought they were all about keeping guns out of the hands of criminals?

    The only silver lining is that felons will now move to NY, and hopefully leave the good states.

  6. Uncle Al – I didn’t say anything about expunging the first offense – only sealing it. It stays on your record. The purpose is to help those who truly made a bad choice and want to rehabilitate themselves. Having a decent job is crucial toward accomplishing that end. Quite frankly, I wouldn’t want to leave that up to a judge and DA. Fool me once shame on you, but you won’t fool anyone again the second time (except yourself)

    The way I understand it, he’s had the PoPo out to his place once before for an attempted break in. He didn’t feel they were pursuing the crime so he lost his temper and yelled at them. That was the incident that started the revoking of his permit. Now you have this young family that’s obviously being targeted by a couple assholes and he can’t protect his family. Unbelievable. The gun play took place on his property. He didn’t need a permit to carry on his property. I’m really hoping L.A. County Sheriffs department is getting bombarded with phone calls. If there was ever a guy that needed to carry, it’s this guy.
    It is a county thing though. My county probably would have supplied you more ammo.

  8. I carried in CA without a permit. The LEO’s knew it. One day at a meeting in city hall I was setting next to a detective from PD and he said…”Your slip is showing”. I thought WTF is he talking about, an he nodded downward and I saw mp pant leg was over my BUG in an ankle holster!

  9. Locally, a guy and his adult son went to pick up pizza at a Papa John’s last week. The father gets out of the truck to proceed into the business to get the pizza and some idiot starts an argument with him. At some point, the idiot pulls a gun on the father. The son exits the truck and blasts the guy dead with five shots to protect his father. The local police chief said the idiot had it coming and no charges will be filed. This is in Texas, of course.
