Where do you see this payout coming from? The city is not liable, the NY Transit Authority is not liable. They are the only ones involved that has deep pockets. Daniel Penny is not loaded and has no means to satisfy a big payout.
The people that ride the subway every day and have their very lives endangered by ruthless thugs like Needly, certainly have a cause of action against a city that refuses to protect them.

Yes, but if he loses in a lawsuit brought by Neeley’s family and is forced to pay, then he might have to use that if he has nothing else.
