Mark McCloskey, St. Louis man who defended home from BLM, explains why he and his wife accepted plea deal

“It’s kind of a non-event, Class C misdemeanor, fine,” McCloskey told McDowell. “It’s a little face-saving for the prosecution’s office.”

Mark McCloskey explained on “Mornings with Maria” on Monday why he and his wife Patricia, both attorneys, agreed to accept a plea deal over a clash they had with protestors last summer. 

The St. Louis, Mo., couple, who went viral after staring down a group of protesters from their front porch, have agreed to plead guilty to lesser charges in connection with the incident, pay fines and lose the guns seized during the investigation.  

The McCloskeys were charged after a swarm of Black Lives Matter protesters broke down an iron gate and ignored a “No Trespassing” sign on their private street. The couple said they felt threatened and armed themselves before heading outside to warn off the crowd, which was on its way to the former mayor’s home. No one was hurt.

McCloskey told FOX Business’ Dagan McDowell that when he and his wife showed up to court “the new prosecutor dropped all the gun charges and the felonies.” 

“He presented me with a charge that said I purposely placed other people in apprehension of immediate physical injury,” he continued. “Well, heck that’s what I did.” 

McCloskey noted that “the whole purpose” of holding guns was to “make people back up [and] put them in that immediate fear of physical injury.” 

“That’s what kept them from killing me and burning down the house and so it was kind of hard for me to say that I didn’t do that because that’s what I did,” he explained. 

McCloskey said he will pay a fine of $750, and his wife will pay an additional penalty on a different misdemeanor charge.  read more

  1. I just lost all respect. Why not make a stand where it counts. They were armed on private property fending off an angry mob. Do they consider this a victory? I sure as hell don’t.

  2. I get the feeling he didn’t press it too hard because he didn’t want himself and his wife to lose their law licenses (their livelihood) or their ability to own firearms in the future.

  3. I think you’re right GA Native. America doesn’t have even a semblance of a real “justice” system these days (if we ever had one). The state (cops, prosecutors and judges) has all the power and control with any criminal charges filed against an individual. Corrupt prosecutors (which is practically all of them from my limited experience) knowingly allow cops to destroy evidence, falsify records and other evidence, etc. because they are willing to do whatever it takes to protect corrupt cops and win a case whether the means of doing so is legal or not.

    The McCloskey’s were on the wrong side of the current narratives. Missouri’s corrupt prosecutors (Soros backed Kim Gardner and her ilk) and judges quite likely would have found a way to really stick it to them if they put the judge and prosecutors to the trouble and public spectacle of a trial.

    That’s why any normal person (unlike antifa thugs) accused of a crime (no matter how innocent they may be of the charges against them) often has no viable alternative other than pleading guilty to lesser charges because the system is so corrupt that there is really no way to prove your innocence (which sadly is now the de-facto standard rather than the state having to prove you are guilty as our Constitution instructs).

    The state holds all the cards and they can effectively do whatever they want whether it is legal or ethical because there are no honest brokers above them to stop them. It’s not like you could call in the DOJ or FBI to stop the corruption because they have proven themselves to be the among the most corrupt agencies anywhere.

  4. @TigerEyes – I think that as lawyers, they knew they were bucking a stacked deck if they didn’t take the plea deal. It truly is a roll of loaded dice these days to try to fight “the state” at anything. See the local school boards having people arrested for disagreeing with them, people being kept as political prisoners in solitary confinement without bail for supposedly “trespassing” on 01/06, etc.

    They gave up the guns they had in return for retaining their God given rights to buy more guns (sadly, that is a choice people are forced to make these days). Any innocent person trying to fight charges of crimes (as accused by the state) these days is rolling a pair of loaded dice against “the house” (prosecutors, cops and judges).

    Until things get bad enough, “rights” are determined by the corrupt scum that are currently in power. It only makes sense when you realize that people sometimes have to lose in the short term to prevail in the long term – they still have their “legal” rights to own guns, but they now can get better guns than they had ……. with the “blessing” of our current “legal” system.

    Folded his hand, and wet himself in the meantime.
    He’s a defense attorney. There’s our first clue. There’s your sign , as Jeff Foxworthy would say.
    Lawyers, they really don’t like to get their hands dirty. Typical expectations and got typical results.
    I don’t think you will want this guy in your fox hole and watching your backside.

    In other words “He’s all Hat, and no Cattle”

  6. You’ve got this, you’ve got people rotting in prison for “trespassing,” you’ve got people arrested at public schools for publicly using words. Plus many more. I’m so sick of this shit. The left has weaponized enforcement against conservative thought and ironically it’s us who they call the fascists nazis. And you’re all right, giving an inch on this just gives them more power. However when you’re given a choice – more fines, arrests, solitary confinement or take this reduced charge, you’re at the point where you’ll do anything just to get back to life, work, family. It’s fucking twisted and evil.

  7. Getting caught up in the jaws of “justice” is never a good thing.
    He did his calculus and this came out the better answer for he and his wife.
    St. Louis is STILL a cesspool and the stink won’t wash off.
