Pollak: Senate Can Acquit Even If House Withholds Articles of Impeachment

What happened?

Breitbart: Speaker of the House Nancy Pelosi (D-CA) appears to be considering an idea Democrats have floated for several days of holding back the articles of impeachment to exercise leverage over the Senate and the president.

She declined formally to transmit the articles to the Senate on Wednesday evening after the House voted to impeach President Donald Trump.

Unfortunately for them, the Senate can act, regardless — and would vote to acquit.

That’s because the Constitution is absolutely clear about the Senate’s authority. Article I, Section 3 says: “The Senate shall have the sole Power to try all Impeachments.”

That is all.

The Chief Justice presides over a trial involving the president, but the Senate makes the rules. And the Senate is controlled by Majority Leader Mitch McConnell (R-KY), who regards what the House has done with contempt.

  1. I read she (house) doesn’t have to transfer the articles to the Senate. She should but she’s stalling and being the quite the loose dentured bitch. And that looks very bad to the public.

    BUT, Cocai… er.. Mitch McConnell can start a trial and bring on any witnesses he likes. And Nancy, nor Schumer, can say dick about it.

  2. Washington DC has lost all my respect. Now they have nothing over me but tyranny, and can enforce nothing except what can be done at the point of a gun.

    In other words, they have lost the consent of the governed. They hang on to power only by the fear of the ruled.

  3. It seems to me the Republicans have all the ammo they need, declassify everything and drop it on the Democrats like a bunker buster bomb.Put an end to this charade once and for all. What are they waiting for? Just saying.

  4. If the Republican Senate DOES make a ‘donkey’ (instead of pony) show of it and thoroughly shames, embarrasses, and discredits the corrupt Democratic House…

Since Nasty Smellosi plans to hold up sending these FAKE ARTICLES OF IMPEACHMENT to the Senate, Mitch should hold two votes, as mentioned under ARTICLE I SECTION III in the article, one to dismiss them & the second to acquit President Trump. He needs to do this today or Friday, just before they leave for their Christmas Break, declaring their FAKE ARTICLES null & void, thus providing each of them with their “Lump Of Coal” Christmas Present & totally driving them totally looney tunes over their Christmas Break. Then on the first day they return, Rudy needs to drop his “Little Boy” bomb on them & a week later drop his “Big Boy” bomb on them. They won’t have time to try to a second set of hearings, because they’ll be busy trying to claw over each other to be the first to sing the loudest & get the best deal, thusly incriminating each other in the process. After a few months of this “Donkey Fight”, kicking, biting, & head-butting each other, Barr & Durham need to drop their MOAB on them with indictments, arrest warrants, asset seizures, & no bail, so they can’t flee the U.S. Then let Avenatti defend each of the Pro-Bono.

    The Constitution is absolutely clear about the entire government’s authority. Article II of the Bill of Rights says: the “Right of the People to keep and bear Arms shall not be infringed.”

    Get back to me in a century. We’ll see how well your “absolutely clear” reading, of “absolutely clear” language, holds up.

  8. Even better… Leader of the Senate, convenes trial with Chief Justice Roberts sitting as judge. Send Senate Bailiff to retrieve Speaker of the House with said articles of Impeachment by force. Have her drug into the Senate chamber in handcuffs. With lots and lots of cameras!

  9. Holding back the articles of impeachment to have leverage over the senate and president? Wouldn’t that be the same as the president holding back financial aid to Ukraine to have leverage over the president? Which he didn’t do, but the Demonrats were so outraged over this and started impeachment based on this premise.
