U.S. Supreme Court Justice Stephen Breyer issued a warning to his friends in the Dem Party about remaking the court telling them to be very careful what they wish for because they may just get it.
In his new book, The Authority of the Court and the Peril of Politics, Breyer says that over time, public acceptance of Supreme Court opinions, even those you may disagree with, has become commonplace
He said this did not come easy and it is key to the rule of law that these decisions are not viewed as partisan rulings.
“He said the most remarkable thing about this case is, even though probably half the country didn’t like it at all, and it was totally wrong, in his opinion and in mine, people followed it, and they didn’t throw brickbats at each other and they didn’t have riots,” he said of what Harry Reid said of the Bush v Gore decision in 2000. more

D2C: The problem that has happened with 3rd parties is this: They are either of a political leaning that won’t gain much traction overall (Communist, Green, etc), or they are started by people who could not get their party’s nomination so they started vanity parties (Wallace, Buchanan, Yang). (The Libertarian Party never really offered much for people to identify with.)
If the Republican leadership were not so inept, they would recognize that there is extreme dissatisfaction with their leadership. But then again, if they weren’t so inept, there would not be such extreme dissatisfaction. That leaves the door open for a strong third party. At this point, I don’t think the GOP losers would be able to co-opt such a party as they did with the Tea Party movement.
Bite me, Breyer. The SCOTUS may as well be a water treatment plant. It would at least serve a purpose, and smell just as bad.

Notice Breyer said, in effect, he thought it important that decisions not be *viewed* as partisan. He didn’t say that decisions should not *be* partisan. Lawyers.
There is a huge difference between 20 years ago and today. Today that decision would have the left rioting in the street and the DC and countrywide dem party would be supplying the pallets of bricks to throw while cheering them on.
