School baseball player awarded $1 million after getting hit by foul ball

EAG- DAVENPORT, Iowa – Public school officials who make foolish facility design decisions are gambling with student safety and taxpayer dollars.

That was demonstrated once again last week, when a former Iowa high school baseball player was awarded more than $1 million by a jury after being hit in the head by a line drive foul ball while sitting in a school dugout.

The incident, which occurred in 2011 at Davenport Assumption High School, left Spencer Ludman, a Muscatine High School player, with a fractured skull, swelling of the brain and a stay in the intensive care unit at a hospital in Iowa City, according to a report in the Quad-City Times.

  1. I laughed so hard and then I thought about the fact, someone driving an ice cream truck should be aware of people (children).
    The sad thing is, this jackass will win a law suit.

  2. Actually, if you read the article, the defendant was a private Catholic School. No taxpayer money.

    Prior to the injury incident, coaches had observed that the lack of an adequate fence allowed foul balls, mostly from right-handed batters, to go into the dugout. They also observed that a fence would have solved the problem.

    They private school did not take reasonable precautions after the defective design was brought to their attention prior to the incident.

    Since the kid suffered a permanent brain injury, this seems like a fair settlement.
