Do state legislatures matter anymore?

AmericanThinker: In a year, Justice Anthony Kennedy has been the key vote in overturning state bans on marriage and now safety restrictions on abortion clinics.  In other words, Justice Kennedy made same-sex marriage “legal” and found restrictions on abortion clinics “unconstitutional.”

This is odd, because Congress never passed a law on abortion or same-sex marriage.  What we call the “law of the land” is nothing more than an opinion written by a justice in 1973 and 2015.

Was this country founded to have people governed by justices who overturn the work of state legislatures?  I don’t think so, and the 10th Amendment is there for all to read.

In both cases, Justice Kennedy threw out the work of state legislatures.  Is that what he thinks of the people?  What in the world does Justice Kennedy, or the other four automatic liberal votes, know about “undue process” on getting an abortion?  Did they come to Texas and see what these restrictions are?

So what is the point of having state legislatures?  Why not just have the Supreme Court decide everything?

  1. Justice Kennedy is, or was, a resident of Sacramento , CA, the Belly of the West Coast Beast He attended th most liberal Catholic church in the city. His nighborhood (mine) is a cesspol of liberal, over educated, most too rich to care fuckheads. Yes, my neighbors. Hard to stay sane.

    But the point is – Why is anyone surprised?

    Actually, a more pertinent question is, are the Republican figures we see on the floor of the House and Senate alive or are they mannequins? Because to my untrained eye, they sure as hell don’t seem to be doing much. I’m fairly plugged in and I didn’t catch anything from any of them about the latest overreach-did someone forget to wind them up?

    Gov Abbot is certainly one of those governors that seem to be serious about states’ rights. And at the other end of the spectrum you’ve the Doormat Twins, McCallife and Hickenlooper(to name a couple from a pool of many)

  3. Los Supremos issue these godlike edicts without constitutional authority. (See my comment on yesterday’s Clarence Thomas article.) Congress can fix this with simple legislation. Cutting back on the Court’s powers is well within congressional powers.

    To Hell with stare decisis.

  4. When a state legislature passes a law that says somebody else should write the rules, they’ve declared themselves irrelevant. Not unemployed, of course, just irrelevant.

  5. Well, my State legislature sure does act like it is still important. There is no issue, however tivial, that they don’t spent much time and resources on in order to make it squeak and interfere with our lives. Right now, they are enamoured with illegal aliens and making sure their lives do not squeak!

  6. At one time the SENATE was filled with Senators appointed by the state legislatures. Those very same Senators approved SCOTUS appointments and retained the right to impeach those very same SCOTUS justices. Now, the Senate is filled with Senators elected by the voters, so the Senate is just a mini version of the House.

    What changed? The PROGRESSIVES gave us the 17th Amendment. Repeal it, Now. Put the Senate back the way The Founders created it.

  7. Once you start accepting those federal block grants, the game is on to completely centralize all power to DC. State and local governments are basically lackeys now to federal edicts that are created based on an international policy auction held in DC on a daily basis.
