Homeowner who found a ‘naked’ teacher’s aide taking a SHOWER in his house, left to get his gun and then shot him dead through the bath curtain is charged with murder

  • Nathaniel Joseph Rosa, 31, was shot dead in Belfair, Washington on Saturday
  • Rosa, a teacher’s aide, was killed after he broke into a home and took a shower
  • The homeowner told police he found Rosa in the bathroom of the home where he runs his online business
  • The man confronted Rosa before going back to his home next door to get his gun
  • Police arrested and charged the homeowner with second degree murder
  • They say he had time to call 911 before the shooting, and they don’t believe he warned Rosa that he had a gun

  1. Sorry, but the situation has to meet all the prerequisites before deadly force can be used or you will be facing murder or manslaughter charges. In general, your life must be in jeopardy. So, a reasonable person would believe that the attacker meant harm and had the necessary tools and intent to use them.

    A guy in the shower does not measure up to that standard.

  2. I agree with Braden. A naked man in a shower is not exactly in a position to threaten anyone with bodily harm greater than throwing a bar of soap at you. Call 911 and let the cops deal with him.

  3. I do believe the image for the lead-in is copyrighted and the term “Law of Self Defense” is a registered trademark. At least use Andrew Branca’s name on it. It’s his.

    Didn’t have to read much at all because Andrew makes things like this clear.

    Clearly NOT self defense.

    Without any more details, this is the clincher: The man confronted Rosa before going back to his home next door to get his gun

    The threat was NOT eminent.

    The force was an excessive reaction to what was presented to him.

  4. the shooter left the building, got a gun, went back in, and THEN shot the guy in the shower? How is that self defense?

    That isn’t self defense, that’s just mean. If he’d called the police and reported an intruder at least the guy would have been able to finish his shower.

  5. The showerer was obviously a fuckin lunatic and the shoot is perfectly justified on that account, if no other.
    Homeowner should have kept his mouth shut, or lied, saying that the showerer attacked or threatened him – or had called him an “izlamic nigger faggot.”

  6. By the way my house is extremely hard to just walk into. The doors are metal and each outside door leads to a man trap second door, or vestibule. The windows are also secured.
    The entire house which is huge has several alarm systems. Not to mention 2 k-9 dogs.
    The property has two fence systems because there is a helicopter landing area.
    If someone gets into my house I would ask them how they did it.
    There is a secret no key no password entrance but it’s not easy to use it.
    Come on people lock your doors.
    Get a big dog they are great.
    I don’t know if I could shoot someone who is just in my shower. Beat them up sure.
    I also would have no problem using a taser on them to get them out of my house.

  7. There are a lot of summer homes in this area which is on Hood Canal. (My sister owns one.) I’ll bet the guy thought he was using one and wouldn’t be bothered by an owner.

  8. in some states, telling someone you have a gun and will use it will get you charged with a) brandishing a weapon and b) making terroristic threats

    I find someone in my crib who shouldn’t be there, I will bellow one warning “GTFO NOW!” and then it’s Go Time if they dont GTFO ASAP

  9. BTW, I would be curious to know why the original article found it necessary to tell us the guy was ‘naked’. I mean, he was taking a shower, for Cripe’s sake!

    I think I could have figured out that one little detail all by myself.
