California Tries To Bust Up Motorcycle Gang By Going After Their Logo For Copyright Infringement

The first-of-its-kind verdict caps an unusual decade-long quest by prosecutors to dismantle the Mongols by seizing control of its trademark.

The jury in U.S. District Court in Santa Ana previously found Mongol Nation, the entity that owns the image of a Mongol warrior on a chopper, guilty of racketeering and conspiracy.

The verdict caps an unusual decade-long quest by prosecutors to dismantle the gang responsible for drug dealing and murder by seizing control of the trademark they said was core to the gang’s identity.

Gang members were “empowered by these symbols that they wear like armor,” Assistant U.S. Attorney Steve Welk said.

The forfeiture still needs to be approved by a federal judge and the practical effect of such an order was not immediately clear. When prosecutors announced the charges in 2008 they said a forfeiture order would allow any law enforcement officer to stop a gang member and “literally take the jacket right off his back,” according to court papers.

Prosecutors wouldn’t comment Friday on what would happen going forward. But defense lawyer Joseph Yanny questioned whether the judge would actually issue such an order and said the novel theory was ill-conceived.

  5. Their “colors” or logo is the equivalent of a flashing neon sign saying they are criminals and making them easy to spot. Why would law enforcement want to force them undercover?
    The implications go way farther with this reckless decision.

  8. The Mongols, Outlaws and Hells Angels I’ve met appear to be pretty reasonable guys, all you have to do is ask them very nicely to take their colors off.
    I propose those prosecutors and other lawyers who are pushing this case be the first to ask the Mongols to relinquish their colors.
    That act alone would eliminate one big problem …. attorneys.

  11. I think it was in a Hulk Hogan movie where Hulk got near some bikers’ bikes and they warned him off.

    He said something to the effect “Whadda ya’ll gonna do? Beat me senseless and feed me to some rabid weasels?”

    And they replied (again, my memory isn’t clear) “No – we got some great lawyers and they’re gonna sue your ass off!”

    It was so absurd at the time it was funny. Now the absurdity has overtaken the humor.
