San Diego, California Residents File Lawsuit Challenging State ‘Assault Weapon’ Ban

SAN DIEGO (CNS) – Three San Diego residents filed a federal lawsuit today challenging California’s assault weapon ban, with the plaintiffs alleging that the state is violating its residents’ Second Amendment rights by its allegedly misguided definition of assault weapons.

The suit, filed on behalf of James Miller, Patrick Russ and Ryan Peterson, as well as the San Diego County Gun Owners Political Action Committee, alleges that the types of firearms banned under California’s definition of assault weapons are lawfully protected under the Second Amendment.

The suit calls California’s usage of the term “assault weapons,” “a politically-concocted pejorative term designed to suggest that there is an inherently unlawful or illegitimate basis for owning otherwise common firearms protected by the Second Amendment.” read more

  1. I wish them well, but have strong doubts it will be successful.

    In any event, the law only affects those who obey it and leaves those who don’t untouched and uninfringed.

  2. Gah, some of you guise can’t see the forest for the trees. (Ha, not sure if I’m using this correctly, but thought I’d give it a try!) They probably *will* lose and I’m pretty sure that hasn’t escaped them, but it’s morally wrong to NOT do anything. Besides, the more pushback the gun grabbers get, the less they will be able to accomplish AND this sort of thing can inspire others, whereas other people’s glum faces telling those filing this lawsuit what a failure their efforts will be only increase the chances they’ll give up. And remember what Churchill (who was half American, don’t forget) said: “Never, ever, ever, ever give up.”

    So I say more power to ya. You never know what could happen.

  3. Dan Bongina said something on his podcast, Friday I think, that has stuck with me. Paraphrasing, he said when “they” want to ban assault weapons, ask “them” to define non-assault weapons, 🤔🙄
