Court Rules in Favor of Electoral College

The U.S. appeals court’s ruling in Denver Tuesday slowed efforts by progressives to eliminate the Electoral College and replace it with a simple popular vote.

The court said Electoral College members can vote for the presidential candidate of their choice and aren’t bound by the popular vote in their states.

The 10th U.S. Circuit Court of Appeals held that the former Colorado secretary of state violated the Constitution in 2016 when he removed an elector and canceled his vote because the elector refused to cast his ballot for Democrat Hillary Clinton, who received the popular vote in that state. more

  1. That’s contempt for exercising authority it doesn’t have.

    The Electoral College is embodied in the US Constitution in Article 2, Section 1, and in the 12th Amendment. 

    That’s the authority, the Supreme Law of the Land… Not some showboat court!

  2. I don’t think that they could eliminate the Electoral College because I don’t think that 37 states would commit political suicide by signing off on it. The Constitution requires 2/3 of the states to vote for it in order to change the law with a Constitutional Convention. I don’t see that happening and if they tried to subvert it any other way I would expect a Civil war.

  3. This decision actually helps the NPV movement. Now electors are free to vote according to the national total and ignore their state vote entirely. And this is all now officially sanctioned by the courts.

  4. The Left is relentless. This shit reminds me of their damn school levies. They just keep dropping them in to be voted on until they pass… now at oddball times of the year when no one even knows they’re up for a vote!

    The National Popular Vote bill would guarantee the Presidency to the candidate who receives the most popular votes across all 50 states and the District of Columbia.
    I’d be all in for this, as long as the counted voters had valid driver licenses and no death certificates. Otherwise, same as it every is,, Democratic Bullshit when democrats loose.

  6. Nowut Ameen: States are going to have to be much more careful selecting Electors in the future. Baca and his lawyers want to eliminate the Electoral College and make the election of the President and Vice President strictly by the popular vote. A direct Democracy rather than the Republican Democracy created by the Founders after great debate and thoughtful consideration. Baca believes that Gore and Clinton should have been sworn in as President, not Bush or Trump. He voted for Kasich to create the legal case that was just decided by the Tenth Circuit Court. There is a method to this madness.

  7. Marco, “faithless electors” are going to have to be much more careful when they return to their home states after casting their votes.

    A few of them found hanging from lampposts should go a long way towards encouraging the others.
