Roger Stone’s legal team files request for Judge Jackson’s removal from case

FOX:

The legal team of Roger Stone – the former adviser to President Trump who received a 40-month prison sentence this week – filed court documents Friday to have the judge removed from his case.

Stone’s defense team argues that Judge Amy Berman Jackson’s claim during his Thursday sentencing that the jury in the case had “served with integrity,” should disqualify Jackson from presiding as Stone pursues his bid to receive a new trial.

They argue that Jackson’s description of the jury as having served with “integrity” was a display of bias on behalf of the judge in a case that has not yet concluded, despite the sentencing, because of the bid for a new trial.

Making the case that the jury’s integrity is in question, the defense lawyers argue that “newly discovered information” suggests “juror misconduct” occurred during the trial, thus depriving Stone of having his case heard before an impartial jury.

The defense lawyers claim the unnamed juror “misled the Court regarding her ability to be unbiased and fair and the juror attempted to cover up evidence that would directly contradict her false claims of impartiality.” more here

  1. This is the sort of thing that is probably intended to set up grounds for appeal as much as to effect the current trial. Smart Lawyers do it that way.

FWIW, it isn’t easy to remove a Judge. Almost never happens.

  2. Her inability to see, or more likely her refusal to acknowledge the presence of a defective juror should disqualify her from overseeing this trial. Or more likely being a Judge in any legal matter in our system of laws and justice. Actual justice is required in countries that don’t operate in 3rd world mode.

  3. Alcee Hastings was removed from the bench.
Must have been an egregious sort. But was promptly elected to the House, which has much lower standards.
If a “judge” violates its oath, even a “smidgen,” it is unfit for the bench. Judicial standards should be higher, not lower, than for the common, run-of-the-mill grifter, wino, dope addict, criminal, con-man, pick-pocket, or meth-head.
We should DEMAND it and hang those who come up short.

No, I’m not simple-minded – I know the legal beagles protect each other in order to maintain that mysterious gaseous sanctimony with which they attempt to surround themselves. But a turd’s a turd – whether in a robe, a “sharp” suit, or a coat-and-tie.

“FWIW, it isn’t easy to remove a Judge. Almost never happens.”

..the only time I’ve ever seen it was when they got Tracie Hunter in Cincinnati, but it took FOREVER because it was Black, Democrat, and Woman privilege AND a connected family that was the only reason she was able to cheat her way in to BEGIN with, but she was
    A) Only a Juvenile Court judge,
    B) Had managed to piss off, disrespect, and ignore absolutely EVERYONE in the court system, including fellow judges and even the Sherriff because of how she treated the security detail,
    C) She was noticably cray-cray,
    D) She even publicly fought with the local, VERY LIBERAL paper that ran cover for her until she crossed them, and
    E) She did some illegal stuff for her brother.

…the last one was how they got rid of her, but they probably would have ignored it if it wasn’t for everything else. They did the usual Black threatening of everyone, including her trial judge and “this city is gonna BURN!” stuff, but it was just out of habit because the whole city, Black people included, was sick of her shit by then.

…so that’s what it takes to get rid of one. Not easy, not easy at ALL.

…and the local media STILL won’t even say what she DID, and tries to make you feel sorry for her, even now, smh, it’s just absurd…

…all this over 6 months in jail.

    And she got out early.

    Of course.

…don’t look for this too often.

    Ain’t gonna happen.

    This is WHY…

    > FWIW, it isn’t easy to remove a Judge.

A bathetically demonstrable lie. Judges, and their entire households, have been proven, quite, easily, removed.

    > Almost never happens.

The world is full of loud, proud, eternal biters of couch pillows.

  6. I don’t even particularly like Stone- but I do hope that this crazy judge gets removed from any cases pertaining to political issues.

She’s bad news and has a cruel streak (Manafort in solitary confinement.)
