Mike Huckabee, neighbors sue Florida officials over ordinance threatening ‘arrest’ for using their ‘own backyards’

BPR: Former Arkansas Gov. Mike Huckabee is going to court over being able to use his backyard access to the beach.

Joining with several of his neighbors on the Gulf Coast of Florida, Huckabee has filed a federal lawsuit over a county government ordinance which has prevented use of what the property owners see as their “backyards.”

Following an executive order issued by Gov. Ron DeSantis which closed beaches in the state amid the COVID-19 crisis, Walton County has stepped up enforcement of the order and social distancing ordinances. But in a lawsuit filed on Monday in the U.S. District Court for the Northern District of Florida, Huckabee and his neighbors claim their constitutional rights are being violated.

The emergency motion was filed requesting a preliminary injunction to stay the county’s action in preventing the property owners from “being able to use or even set foot in their own backyards,” Law & Crime reported.

“The county’s ordinance forces family members into a confined space within their house rather than allow them to social distance and recreate in their sandy backyard,” a memorandum filed with the lawsuit said, according to the Orlando Sentinel.

“Or it forces them to public locations to recreate potentially closer to many other persons increasing the risk of spreading COVID-19,” it continued. “Either way, it is counterproductive. And it is beyond reasonable dispute that any hypothetical, negligible benefit conjured by those who passed the Walton County ordinance cannot possibly outweigh the profound trammeling of the present plaintiffs’ constitutional rights.”

The homeowners claimed the South Walton sheriff, code enforcement officers, and other officials “have been and are currently patrolling and occupying the private beachfront properties” without permission. They were also accused of threatening to “arrest or fine Plaintiffs, their family members, or invitees on their private properties.” read more

    It won’t.

    People have already accepted that the government has the unrestricted right to control their lives in any manner it chooses.

    At least as long as it declares an emergency first, which is obviously an easy thing to do.

  2. And what in the world is going on in Michigan? I just read that the purchase of some produce and fresh meat is being restricted? In Kentucky police will be recording license plate numbers in church parking lots tomorrow, and those that unlawfully go to church will be forced into 14 day quarantine. The current infection rate in Kentucky is .003% of the population. Just wait till we see what the donkeys try to put into the next stimulus plan. We are going to hell in a hand basket folks.

  3. Private property extends to the “high water line” — wherever that is. Everything in Florida from the “high water line” {high tide mark) to three miles out into the ocean (or 9 miles out into the Gulf) is considered to be sovereign land, i.e. belonging to the State of Florida.

    These coast dwellers need to determine where their “backyard” actually ends. It does not go down to the water except during absolutely highest tide. Similarly, the state has no right to infringe on their actual private property (subject to whatever easements and exceptions may be carved out in favor of the city or state in their deeds.)

    I remember the homeowner to got a parking ticket IN HIS OWN DRIVEWAY between the sidewalk and his home. He lost that case. Can’t park your car on your own property.

  5. Today, I did a brake job on my truck. During the day, I went to two O’Reilly’s, one Auto Zone, one Advance Auto, a dry cleaners, a super market, a gas station, a Dollar Tree and a small grocery store. I test drove my truck after the brake job and visited several neighbors in the neighborhood along the way. I do maintain a reasonable distance, but I have yet to put on a mask of any sort during this entire “crisis”.

    meanwhile criminals are roaming free in the city
    most let out of jail by the same officers

    any wonder gun sales are through the roof

  7. File trespassing charges against the sheriff. Keep doing it every time he or one of his deputies sets a single foot on your property without a warrant. If the local police will not arrest the sheriff, go higher and higher, up to the US Marshal if you must.

    Interesting the places where local govt officials and cops are taking things to the extremes they’ve always dreamed of.
    I wonder what the county will do now though. Gov DeSantis has announced he is going to start opening up the state.
