Virginia cop who maced Army Lt. was fired after incident

TMZ: The police officer who pepper-sprayed a Black Army lieutenant in December has since lost his job over the altercation — this as a lawsuit against the cop makes its way through court.

The town of Windsor, VA broke the news Sunday, saying Officer Gutierrez had since been terminated after an investigation following the incident late last year … which determined he did not follow department policy during the hectic traffic stop.

Sounds like Gutierrez — who later suggested Lt. Caron Nazario “let this go” to avoid punishment from the Army, and awkwardly brought up race relations — was actually cut loose a good while ago. Windsor officials say new training was implemented back in January after their preliminary probe into this wrapped. more

  1. I’m reposting my comment from previous post here. My only addition is: why wasn’t the other cop also fired.

    I’m still enraged. Carrying his sidearm on the floor is an appropriate place to put it, and no fricking way those cops could know whether it was loaded or not. Or even whether it was there before they drew their guns. It was nighttime, and the kid drove to the first lighted place to get off the road instead of just pull over in the dark. Absolutely legal. And the kid was dumbfounded about why he was being pulled over in the first place. And, in case you haven’t noticed, kid wasn’t being “belligerant”. He was simultaneously yelled at to show his hands and get out (impossible). And with regard to the “mumbling”, a confused young man who has done nothing wrong, is somehow supposed to know what to say or how to act (other than trying to be still and relatively quiet recognizing that the cops are afraid of him.)

    STOP TRYING TO DEFEND COPS EVEN WHEN THEY ARE WRONG.

    They shouldn;t have stopped him in the first place. They shouldn’t have approached him already belligerant (the cops, not the kid.) And then they should have backed the fuck off when they saw that it was an army officer.

    I’d like to know the political party of these affirmative action wonkers. This was December, in Virginia. Remember what was being carried on about anti-Trump?

  2. There is something a bit off about the video, specifically that this “lieutenant” has some hair on his chin. I know things have been loosened a bit lately as far as hairstyles, but none of the changes were for facial hair. I will go out on a limb and say that this “lieutenant” was not actually in the National Guard, Army Reserve or Army. All that being said, the firing of that one officer was justified.

  3. Brad, My point in posting the GP article was that Lt Nasario did not stop right away, was not cooperative, and seemed to be provoking a confrontation with the Police. As far as the gun goes, I am fine with that. Cops still need to make sure he is a law-abiding citizen when they do see a loaded weapon.

  4. The only thing I never seem to understand is why don’t people do exactly what the coppers are saying.

    I am 95% on the LT’s side. Pulling over in a well lit area is quite tolerated up here and is encouraged most cases esp if you are a woman. In this case the cop got his alert way up because the LT continued to the Gas Station.

    I just don’t get why the LT didn’t just stick his hands out the window. That would have de escalated the whole thing quite quickly.

    Once again, I’m on the LT’s side but you have to help yourself a bit too.

  6. Many (not all) of today’s police officers would never have a position of authority in their life, now they have the authority and a gun.
    In EMT training, I’ve also seen how far a Meth-head can go after being shot multiple times. The police do not have a one scenario fits all job.

    I only watched the video once and it looks like a situation where the cop’s badge is much bigger than the officer’s mentality and training.

    He was entitled to know why he was pulled over, especially like that.

    He was confused, nervous, and most likely couldn’t even make out what the assholes were screaming in back of him, next to noisy busy traffic, from pretty far behind his vehicle. If this kid is LT2, he is: young, a college grad, and has never been in criminal trouble.

    I do not want Stupid carrying the authority of the state’s police power.

  9. Note: Have a plan, turn dome light on and keep hands on the steering wheel or put them out the window.
    Being to helpful can get you killed. Move very slowly. Don’t reach for anything after you are stopped unless you are told to. Then very slowly. When I was a kid I almost got shot by getting out of the truck and going for my wallet in my back pocket. I think I freaked the cop out because he told me never do that again.

    Cops have some issues. I went to the Hay Adams when that cocksucker Obola was there to repair and 8X8. I was getting ready to drive out there and decided to leave my shears on my desk. I got to the shithole and was passing through the mag and this SS prick put my left arm over my head and squashed me into the side of the mag. He screamed into the side of my head, “WHAT DID YOU CARRY HERE?”

    “Shears, I’m a telephone man, but obviously the pouch is empty.”

    Or something to that effect. I was pissed to be touched at all, much less fucking squashed and manhandled by a fucking retard. I’d still be pissed if he wasn’t a retard.

    No fucking reason to touch me. No reason to squash me. No reason to scream at me “ask” me what wasn’t there.

    “I lost my keys once. It was a bad day.”

    He’s looking at me like I had 3 heads. He can’t fathom how a worm like my can lose an entire set of keys.

    I couldn’t start the phone truck. I couldn’t start my own vehicle. I couldn’t get into my house. I have a chain on my keys that snap to my belt.

  14. The whole video explains that the LT ignored lights and siren for a mile and a half. Then he pulls over in a well lit place. Officer does know how many people, or who are in the vehicle. Not pulling over is cause to implement a felony stop. Officers were in their right to question over the lack of plates. LT did not comply with repeated orders to exit. Just because he has BDU’s on doesn’t prove anything about his identity.

  15. Now that George Floyd’s family got 27 million $, we are going to see a lot more belligerence out of blacks interacting with police. Those (D)umbasses are buying a lot of trouble – which will mostly get blacks killed.
