U.S. Rep. Mo Brooks released video footage from a home security camera that appears to show a process server entering the garage at the congressman’s Huntsville residence to serve a lawsuit to his wife on Sunday.
Brooks and his wife, Martha, filed an incident report with Huntsville police for criminal trespassing following the Sunday incident.
Brooks has been sued by California Congressman Eric Swalwell in connection with the Jan. 6 siege of the U.S. Capitol. Brooks is a defendant in the lawsuit along with former President Donald Trump, his son Donald Trump Jr. and his attorney Rudy Giuliani.
During an appearance on a Huntsville radio station Monday, Brooks’ wife said she was “terrified” after exiting her car door to find a strange man holding a cell phone about two feet from her face as he videoed their encounter.
ht/ corky
What is the point Smallwell’s childish crybaby lawsuit? He can’t possibly succeed in whatever he hopes. More likely, Nancy’s pet puppy will end up losing a countersuit.
That process server creep may not have entered the house, but he sure as hell entered the curtilage. That’s legally the same as the dwelling proper.
That’s in Alabama. That dude is lucky she didn’t blow his head off (completely justifiable in that he rushed into her home without her permission).
Delivering to Mo’s wife is substitute service. Not the same. Mo still has to be served. Might even be illegal in Bama to subserve.
Each state is different. Tell Swallwell to go take a hike. Then countersue for harassment, stalking, etc… the charge doesn’t matter, what does is DISCOVERY.
It’s the only fun part of lawsuits.
Damn you, Uncle Al; I had to look up “curtilage”.
If that was a situation Brad was involved in, I can almost guarantee the guy with the cell phone would have been room temp after a few seconds.
@Tony R — I had to look up “curtilage” some time back when I was reading up on gun laws and the legal issues around search warrants and 4th Amendment stuff. Fun!
But, yeah, it’s not exactly a word you hear in everyday conversation, is it?
So the guy took video of himself serving the papers to the wrong person?
Remind me not to hire that guy if I ever need a process server.
Well Uncle Al, you could have gave us dummies a clue.
Enter my garage like that you aren’t waling out alive.
How the hell is that serving Mo? The speed at which that guy came up he is lucky he wasn’t shot! Counter sue!
Curtilage is that rubbery stuff in your finger joints.
You sometimes find it in chicken thighs.
tastes good but hard to chew …
Look at her backing him up. LOL
He came in there so fast he had to be stalking the place.
Swallwell is a loser traitorous tool.
Just another of the 332,803,668 reasons to carry in the US.
Two big “ifs”: If this happened in Co rather than Ca and IF she had a cc that dude would be scraped off the garage floor by a coroner.
A strange guy holding a phone in my garage waiting for me to exit the car AND I’m in a high profile litigation with an elected Democrat… …. “officer I thought he was here to kill me and was going to film it with his phone”
Dude dead, word goes out to servers ‘mind your P & Q’s while serving papers’; world a slightly better place. A win all around.
IMPEACH 46!
I hope they have a counter-suit filed against swalwell. They could make him homeless in no time. Guy can’t even make payments on his student loans.
The scary thing about this whole shambolic display is how the democrat overlords are able to unleash their flying monkey’s on a person’s property with no fear of reprisal. Especially a spineless wimp like Swalwell.
