JTN: The United States Fifth Circuit Court of Appeals on Friday ruled that the Bureau of Alcohol, Tobacco, Firearms, and Explosives lacked the authority to finalize a rule banning the ownership of bump stocks.
The court determined en banc that bump stocks do not classify as “machineguns” as defined by federal law and therefore the ATF could not issue a ban on such products. A bump stock is a type of handle that may be affixed to a semi-automatic firearm. A user holds down the trigger and the gun’s own recoil to effect a repetitive pulling of the trigger.
“A plain reading of the statutory language, paired with close consideration of the mechanics of a semi-automatic firearm, reveals that a bump stock is excluded from the technical definition of ‘machinegun’ set forth in the Gun Control Act and National Firearms Act,” the judges determined. more
Good news. Now the manufacturers need to sue ATF for lost revenue and court costs. Maybe a class action lawsuit for all the bump stock owners who turned theirs in or destroyed them as ordered by ATF? Sue the individuals responsible, not just the agency.

That bump-stock ban was implemented during the Trump administration/2017. It is not over either. But see smart-as guy bump stock pretty much useless for the shooter has no accuracy.

It was a panicky response to the Las Vegas sniper incident. Obviously a horrific incident – and just another great example of responding to a single incident by creating rules that take away our rights. We must always be vigilant for such usurpations of our rights.
Now do frames, receivers, short barrels, suppressors and select fire.

Bump stocks were made to help disabled vets keep going to the firing range.
They do not turn anything into an automatic weapon.
Maybe the disabled veterans’ groups should sue.

It may be a court that views these as 2nd amendment violations, or it could be a way of expediting the sought-after population reduction.

It’s important to keep in mind that the courts are striking down laws written and created by the ATF and the DOJ. That’s not their job. In fact they have no authority.
While they’re at it, there’s no real reason a non-firing part like a suppressor needs to be an NFA item.

ar-15 arm braces were created to aid disabled vets control their weapon, not bump stocks.
As far as bump stocks go, there’s a much more reliable product out there called a Rare Breed trigger. The ATF is losing their minds over it. After this latest ruling I think Rare Breed will have precedent to win their defense against the ATF for the same reasons that the bump stock ban was thrown out.

Bump stock in no good unless you have a 30 clip magazine and your firing BB 12 gauge. Drop the theatrics and learn precision shooting.
