Military veterans sue Biden administration over ATF regulation of stabilizing braces

Agroup of military veterans are suing the Biden administration over a rule from the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) that would reclassify many pistols with stabilizing braces as “short-barreled rifles.”

The ATF rule would subject such weapons to regulations under the National Firearms Act, which in turn would require owners of such firearms to secure federal licenses, according to Fox News.

The suit contends that the rule is both a violation of the Second Amendment and also constitutes executive overreach as the rule lacks congressional authorization.

The Wisconsin Institute for Law and Liberty (WILL), which filed the suit on behalf of a group of veterans, asserts that the stabilizing braces were invented to aid disabled veterans in firing pistols safely.  MORE

  1. It’s many peoples opinion that the registration process is a trap. Including the attorneys for the GOA.
    Somebody needs to step up a sue the shit out of the ATF for number 1, righting laws. You can call it a “Rule”. But they’re enforcing it like a law. Number 2, Make SBR’s legal. They were never supposed to be on the list in the first place. And they’re damned handy to have.

    How about suing them on the basis of Americans With Disabilities Act?
    I know a whole bunch of handicapped shooters who NEED a brace, just like the NEED ramps, wheelchairs, canes and other devices to ensure mobility & do things safely.

  3. I pulled mu buffer and Tailhook brace off and put a short buff tuned with a 9mm spring. The Tailhook has been re-purposed as a fold out helmet holder on the tour pack of my motorcycle
