  2. This was a horrendous decision, but there may be some lessons in this:

    1. In the employment field, there is a non-legal concept referred to as “optics” – how did the employer’s actions look? Juries are already wary of evil employers even before any evidence is presented, so it is important that in making employment decisions, optics are considered. In court or administrative hearings, employees usually start out ahead.
    2. Know your jurisdiction. Los Angeles County is a notorious liberal jurisdiction known for large verdicts. So are Cook County and New York.
    3. In California and many other jurisdictions, there is a statutory requirement of “reasonable accommodation.” In this case, the plaintiff could not work with cats because of pregnancy; the employer was obligated to at least meet and try to find other work for her. This is generally a non-waivable obligation.
    4. California treats pregnancy as a disability, and employees generally cannot be fired for being pregnant.
    5. Many employee protections in the labor law field are non-waivable. For example, an employee may not waive a statutory meal period just to leave early – even if that employee asks the employer to do so.
    6. If you are ever in a court proceeding, keep in mind that almost everything is either recorded or transcribed – sometimes both. This means that every time you use inappropriate language, act inappropriately, insult someone, etc. etc. there is a chance it will end up before a judge and/or jury.
    7. Los Angeles and most (if not all) of California is a sanctuary jurisdiction. There will be volumes written about the legal ramifications of this, but whether or not you are in a sanctuary jurisdiction is something to keep in mind.
