The opinion in these cases is the furthest extension in fact—and the furthest extension one can even imagine—of the Court’s claimed power to create “liberties” that the Consti­tution and its Amendments neglect to mention.

This practice of constitutional revision by an unelected commit­tee of nine, always accompanied (as it is today) by extrav­agant praise of liberty, robs the People of the most im­portant liberty they asserted in the Declaration of Independence and won in the Revolution of 1776: the freedom to govern themselves.”

    Meh. If I were going to gas someone, I’d use argon. This conspiracy-theory stuff is all in good fun, but I had lunch with Scalia about 3 years ago, and I remember thinking that he looked old, overweight, and not so great. His mind was lively, but I worried that he might not make it to the end of Obama’s term and said a small (unheeded, apparently) prayer that I was wrong.

  3. Great opinion! He will be missed.

    We’ve been in this state for some time, and for many different issues. The courts were of great concern to our founding Fathers when the Constitution was written. Their concerns tyranny from the courts is upon us. What do we do?

    Elected judges can be just as corrupt or activist. Should the States be able to override or veto a high court decision? Term limits for judges with periodic impeachment votes by the people or States to cleanse the judiciary of activists?

    It is time to rein the courts in.It will only get worse with the moral decline of the country.

  4. This event could change the course of the upcoming election, in a similar way as the shut down of the government in recent years.

    Scalia’s untimely death could be a catalyst for the democratic party to use in manipulating the public into thinking the Republican’s are obstructionist.
