As Predicted, the Chickens of Gorsuch’s Horrible Transgender Decision Come Home to Roost

PJM: When Supreme Court Justice Neil Gorsuch redefined “sex” in federal law, twisting federal bans on sex discrimination to include discrimination on the basis of sexual orientation and transgender identity, his colleague Samuel Alito rightly warned that the decision would wreak havoc on the health care industry. Almost exactly one month later, the ACLU filed a lawsuit to force a Roman Catholic hospital to perform transgender surgery in violation of the Hippocratic Oath, citing none other than Gorsuch’s opinion. more

  1. I am beginning to think the SCOTUS is hated by the ‘right and left’, okay so not much left these days, but the SCOTUS building may go before Mount Rushmore. The former is much closer to the mob.

  2. Hippocratic Oath

“I swear by Apollo the physician, and Asclepius, and Hygieia and Panacea and all the gods and goddesses as my witnesses, that, according to my ability and judgement, I will keep this Oath and this contract:

To hold him who taught me this art equally dear to me as my parents, to be a partner in life with him, and to fulfill his needs when required; to look upon his offspring as equals to my own siblings, and to teach them this art, if they shall wish to learn it, without fee or contract; and that by the set rules, lectures, and every other mode of instruction, I will impart a knowledge of the art to my own sons, and those of my teachers, and to students bound by this contract and having sworn this Oath to the law of medicine, but to no others.

I will use those dietary regimens which will benefit my patients according to my greatest ability and judgement, and I will do no harm or injustice to them.

I will not give a lethal drug to anyone if I am asked, nor will I advise such a plan; and similarly I will not give a woman a pessary to cause an abortion.

In purity and according to divine law will I carry out my life and my art.

I will not use the knife, even upon those suffering from stones, but I will leave this to those who are trained in this craft.

Into whatever homes I go, I will enter them for the benefit of the sick, avoiding any voluntary act of impropriety or corruption, including the seduction of women or men, whether they are free men or slaves.

Whatever I see or hear in the lives of my patients, whether in connection with my professional practice or not, which ought not to be spoken of outside, I will keep secret, as considering all such things to be private.

So long as I maintain this Oath faithfully and without corruption, may it be granted to me to partake of life fully and the practice of my art, gaining the respect of all men for all time. However, should I transgress this Oath and violate it, may the opposite be my fate.”

  3. When someone asks me to work on a piece of equipment that I am not familiar with or do not want to work on, I just say that I do not have the expertise.

Can they not just not staff the type of doctors that specialize in these surgeries and refer them down the street?

    Asking…

  4. So, stare decisis only counts when it favors the left? What about the Little Sisters of Charity decision, where the court said you can’t compel them to go against their religion?

  5. I’m not sure how it works exactly, but couldn’t someone challenge the ruling in another lawsuit, bringing it back to scotus eventually?

And maybe twist Gorsuch’s nipples til they bleed?

…that IS an interesting point you and @Uncle Al make…not every hospital does every thing, nor is it REQUIRED to…I would not take an obstetrics patient to a geriatric medicine hospital, nor a psych patient to a heart hospital, nor an adult trauma patient to a childrens hospital…despite the fact that they all work on people, they do NOT all have the same expertise, so I would be remiss in some instances and outright malfeasant in others if I chose incorrectly…and this type of mutilation crosses MANY disciplines, such as vascular surgery, endocrine specialties, DEFINITELY plastic surgery, psych services, urological concerns…not every hospital can have a trained specialist to DO all these things, let ALONE for a purely ELECTIVE surgery…this is no more “necessary” than breast augmentation or tummy tucks, and I don’t see where you can compel a hospital to do THOSE…

…and SOME hospitals you wouldn’t WANT doing them…I won’t call it by its local, real name, but the general hospital where all the hard cases and gun and knife club members wash up won’t have any SOCIAL objections to cutting your nutz, but that first-year resident might be a little loopy after 14 hours of bowel resections and Penrose drain installations from abdominal GSWs to be able to concentrate fully on splitting your dick in a way that can be folded back to ape labial lips, just sayin’…

…and “nutz” is what they DON’T want, except across the nose…

  8. There’s a prophecy floating around out there that TWO Supreme Court justices are going to step down.

    JUUUUUUUUUUUUUUST throwing that out there…

  9. A replay of the bakery / gay wedding cake fiasco. They identified a place they knew would not meet their demands for the sole purpose of filing a lawsuit. Brings to mind the old joke;

What is a crying shame? A bus load of lawyers going over a cliff with an empty seat.
