Trump biographer Michael Wolff sued First Lady Melania Trump late Tuesday to stop her from filing a defamation suit over his statements about Melania and Donald Trump’s relationship to convicted pedophile financier Jeffrey Epstein.

Wolff, a journalist whose upcoming book is tentatively titled “The Art of Her Deal: The Untold Story of Melania Trump (Redux),” claims Melania Trump’s lawyers sent a letter threatening to sue him for over $1 billion in damages and demanding he apologize for suggesting online that she is playing a behind-the-scenes role in the Trump administration’s messy handling of the Epstein files.

“It is not defamatory to say that Mrs. Trump is actively managing the present White House response to the controversy. Nor is it defamatory to say that Mrs. Trump was involved in Epstein’s rather expansive social circle,” Wolff wrote. More

  2. Wolff’s lawsuit seems to seek an advisory opinion from the court, which is not allowed. Courts adjudicate actual controversies, not hypothetical situations. So far as I can tell, Melania Trump has not actually filed anything.

    Ironically, Wolff’s lawsuit may actually be subject to an anti-SLAPP motion even though he supposedly filed his lawsuit under New York’s anti-SLAPP statute. The analysis can get a little convoluted, but anti-SLAPP motions are directed to actual lawsuits – not threats of lawsuits. In filing his “preemptive lawsuit,” Wolff seeks to obtain both an advisory opinion as well as chill Melania’s right to use the courts for redress of grievances.

    As a disclaimer, I am not overly familiar with New York’s anti-SLAPP statute, but I don’t believe it extends to mere threats of litigation.

  4. @Bad_Brad: Not to be insulting, but you could be an attorney – a lot of it is common sense. But you are correct – an “advisory opinion” is a fancy way of saying someone is asking the court to rule on something that hasn’t happened yet; that’s why courts don’t entertain them.

  5. Wyatt, I consider that a huge complement. Thank you. I respect and enjoy watching the real deal. Like any trade or profession certain peeps should not have applied. You may be able to pass the bar, but that doesn’t mean you can argue or research a case. Then you become a politician. You sir are in an honorable profession that types way to much, lol, that been inundated by ignorant people chasing a dollar. I wish I would have run into you about 15 years ago. Contract law sucks.
