Excuse Meeee! 9th Circuit Court Not the MOST Overturned Court in theU.S.

Hannity said that the 9th circuit court was the most overturned in the country.

It’s not. It’s 3rd. It has a 79% overturn rate, 2 other courts have higher.

Politifact jumps all over Hannity, focuses on his hyperbole, and that haughtily cups and sniffs their fart and says Hannity is dead wrong, as if the 9th circuit court isn’t a horrendously progressive activist court who gets overturned at an alarming rate.

They act as if Trump doesn’t have a leg to stand on after he said, “see you in court.”

    I STILL say it’s the 9th’s dumba§$ decisions that make the headlines.
    Their CONSCIOUS intent is to overthrow…err…overturn America.

  2. The Ninth Circuit Court supports islamic terrorists entering the US without any restrictions, is unconcerned for the safety of Americans or our institutions and ignores the Constitutional powers of the Executive Branch of Government.

  3. Imagine working for an employer where you screw up and make an error that has to be corrected most of the time. How long do you think you’d keep that job?

    Perhaps Congress needs to set a standard for the appeals courts (all of them) that if they exceed a threshold of reversals the all the judges get’s replaced.

    Imagine the time, money and resources that would save in cases not having so many cases go to the supreme court for correction.

    Of course my suggestion goes all to hell the minute one side or the other gets the majority on the Supreme Court, but wouldn’t the whole legal system be more in line with the values and norms of “we the people” if there was some standard they jurist had to meet in order to keep their job?

  4. This’d be a good time to remember that Congress has Constitutional authority to set the courts’ jurisdiction.

  5. You need to know some of the other numbers here to make proper sense of this. Only a quite small percentage of cases decided by the Circuit courts ever go to the SCOTUS on appeal, so the reversal rate is misleading: the 9th CC’s 79% doesn’t mean that it gets only 21 out of 100 right, it means that of the one or two pct of its decisions accepted for review by SCOTUS most are overturned. The take-away is that if you use a ballpark rate of one out of a hundred of its decisions being reviewed, then the SCOTUS overrules them not 79% of the time, but more like 0.79% of the time if you look at all their decisions rather than only those appealed and accepted.

    This isn’t a defense of the 9th Circuit, far from it.

    And I note that the Politifact article, while mentioning some overall numbers, carefully avoids telling us how many cases the 9th handles compared to the other Circuits. The 9th is by far the biggest and busiest one, and it is quite possible that SCOTUS does overrule a higher percentage of the 9th’s total decision count rather than the reviewed decision count than other Circuits. I don’t know and can’t be bothered to run the numbers at the moment.

  6. Remember when basic civics was taught? How the three branches of our government are co-equal, with each having a significant check on the other two? Why oh why have we allowed things to devolve to a point where it is popular opinion that the courts are above the other two branches? This has been bugging me for a good while. Picture an organizational chart, like you see for large companies. You have a CEO at the top, perhaps several VP’s just below him, each responsible for different divisions.
    Now picture that chart with the three branches of government. All three are on the same level–the VP level–with the Constitution in the CEO spot. Or at least that’s how I see it.

  7. All I know is I’ve been watching FOX News on and off since the election and I may have missed any positive stuff about President Trump. But Wallace, Smith and their gang don’t give him any quarter. I wonder what CNN,ABC,CBS, and the rest must be on to.
    It seems that every word out of his mouth is being criticized. They are vilifying his daughter, his wife, his staff. Something very wrong here. The elites and the neer-do-well Soros employees seem to have bandied together with the democrats and the MSM to stop Trump at any cost. Yup, something very wrong. This keeps up, someone’s in deep shit. I’m just wondering when the shit will hit the fan.
    Imagine Chris Wallace crowing “the 9th Circuit just slapped down Trump,” and seemed to say it with glee. Something wrong here.

  8. So the 9th Circuit is over turned 79% of the time and there are 2 worse districts? Are there any other jobs in the world the one gets to keep when they are wrong more then 79% of the time?

  9. Listening to local talk radio on the drive home just now and they are reporting a couple of the justices want a do over and have all the justices re hear the case. Either they’ve embarrassed themselves or they really want to drive home their point.

    I don’t think any of us are conspiracy theorists …. but…..There does appear to have been a well organized and well funded effort to undermine the very lynch pins and existence of our republic for several decades.

    Over this time frame an effort to attack and vilify Christians, destroy marriage and the family unit, rewrite US history, dumbed down education, elevating socialism, destroy the sanctity of life, acceptance of immoral behavior, fan the flames of division, it takes a village (government) to raise a child, limiting parental rights, one world versus national sovereignty, limiting liberty and freedom under the guise of safety, judicial activism, government used as a tool to limit freedom of speech and to further social decay and increase government control, acceptance of evil over good, etc., etc., etc.

    Just like was said in the 60s and 70s; “Just because you’re paranoid, doesn’t mean they aren’t out to get you.”

    The road we are traveling today is filled with pot holes (obstructions), diversions (fake news), division and deceit.

    All I can say with clarity is that I continue to pray for our young Nation and our President.

  11. And that disgraceful record is a function of Chuck Schumer the Democrats obstructing of any nominee that GW Bush put up unless he was acceptable to Schmuckie & the Democrats. AND, and this is a big part of the problem, that eight years of capitulation by the Bush wing of the Republican Party (God, I hope we have seen the last of those reprobates) was followed by eight years of establishment Republicans rubber stamping anyone Obama nominated. AND both of these came on the heals of eight years of Clinton. Twenty-four years of the Democrats pretty much shutting down anyone they didn’t think they could control pretty much has made a mockery of the entire Court of Appeals.

    This mess is not going to be repaired as easily as many people think it will be. But we have to start somewhere.

    I think the other judges saw how admiringly the media reported on the Towering Trio’s shredding of the hapless Trump team. They want a chance to flay some hide for the press, too.

    Plus, I guess a full-court encore would delay any hearing on whatever rewrite the Trump team comes up with.

    This shit has to stop yesterday. I am not going to be ruled by enclaves of unelected federal judges for the next four years.

  15. Alternative fact: The 9th Circus has the highest number of cases that are overturned by the SCOTUS.

    Yes, they take more cases from the 9th than any of the others, but is that because more people appeal the shitty rulings of the 9th Circus?
