Federal Judge Finds Law Banning Mexican American Studies Class Unconstitutional

After five years of battling in the courts, supporters of Mexican American studies in Tuscon, AZ schools have a ruling by a US District Court judge who found the law forbidding the curriculum was “racially and politically motivated.”

The original state law passed in 2010 allowed Arizona to withhold school funds from a school offering classes that “promote the overthrow of the United States government; promote resentment toward a race or class of people; are designed primarily for pupils of a particular ethnic group; advocate ethnic solidarity instead of the treatment of pupils as individuals.”

Rather than design a curriculum that met the law, advocates have been seeking a repeal of the law itself. They found a federal judge willing to rule it unconstitutional, thus opening the door have the law voided.

Judge A Wallach Tachima and the Ninth Circuit initially upheld most of the provisions of the original law but the judge was instructed by the Court  that it “could still be unconstitutional if enacted for political or racial reasons,” which he found in his ruling on Tuesday.

    Will The First Semester Focus on Long Ago Dead or Settled Mexican Land Grants ? If So Students Will Demand That Much of the Southwest is Theirs . Statues are an Issue, But This is A Liberal ” A Bomb ” !!!

  2. All these hyphenated ethnicity labels need to be shit canned. Either you’re an American or you need to get the hell out of my country. It’s not a melting pot, it’s enclaves of invaders who intend to colonize parts of our nation.
