Officers Gave Crazed Subway Rider in Marine Chokehold Case NARCAN, Not CPR

The officers admitted the man had a pulse and was breathing when they arrived and opted to give him Narcan, not CPR.

They killed him, not Daniel Penny.

Case dismissed.

And Alvin Bragg, the low-IQ and dyed-in-the-wool commie NYC DA, is trying to prevent the defense from bringing up the decedent’s history of drug abuse.

Uhh, the police gave the known problematic subway rider NARCAN!! I think “drug abuse” is germane here. But what do I know? I’m not a DEI hire.

    On one hand it says Penny had him in a fatal hold and on the other hand it reports that the cops admitted EMT’s gave him Narcan even though he was conscious.

  2. My father USMC WW II combat vet taught me what he called the ‘Japanese Stranglehold’ when I was a kid.
    I used it only once- it worked like a charm.
    (Not sure how many times he used it.)

    …whether nasal or injection, Naloxone/Narcan has to be in an at least PARTLY fuuctional circulatory system to do anything, even if that limited fuctionality comes from someone doing compressions. It isnt magic, it needs to be carried to its destination by the blood, so you still gotta pump ’em to give it a chance even if it IS an overdose situation.

    Blowing Narcan up dudes nose then standing back is like putting the jumper cables on a car then not cranking it. Youre kind of missing a step there…

    …it wasnt a terrible start given the guy WAS acting crazy and drugs MIGHT have been involved and the chokehold MIGHT have been incidental and dude MIGHT have stopped breathing anyway, but regardless you need to turn the crank to get the motor running, and they simply did not do that.

    Cops dont really relish medical tasks anyway, it wasnt really what they signed up for and they tend to worry about being attacked WHILE both hands are engaged in CPR, but if they ARE trained then the “Reasonable man” standard usually attains. This is whether a reasonable person in the same job with the same training as the officer in question would have done the same thing in the same circumstances.

    If the answer comes back NO, then the officer can be held liable for withholding aid and possibly for wrongful death.

    Its also been my personal experience that the kids are a LOT more squeamish now about smashing a persons chest repeatedly let alone breathing in their mouth, maybe as a consequence of Coof; but it also isnt something everyone has ever HAD to do, and believe me Ive seen time and again that no one knows what they are and are NOT personally capable of until actually faced with a crisis situation, and training can only give confidence in trchnique, it doesnt tell you how youre going to react when youre faced with an apparently dead, probably not very clean, and possibly toxic with Fentanyl or a hundred diseases guy on the floor of a mode of public transportation while ringed with screaming shouting people, many of whom have their cell phones out, as you watch a rill of pinkish foamy sputum dribble listlessly from his purpled lips.

    ..A lawyer, which I am NOT, would have to say if any of this would exonerate Mr. Penny. I would guess NOT, as he is the presumed proximate cause of dude not breathing in the first place, and it could be argued that any sequele following from that is a consequence of the original action.

    Whether or not it was justified is an entirely different subject. I am speaking only to the medical response (or lack thereof) here…

  4. Penny appears much more discerning, articulate and measured compared to that dumbass Kyle Rittenhouse.

    The video actually helps Penny. If this was a proper chokehold, Neely would have been out very quickly, the fact that he was still struggling proves that his airway was never constricted. This is also backed up by the video which shows the forearm not on the neck or depressing it.

    Was the autopsy ever made public? This would prove the cause of death and the tox screen would reveal any drugs in his system.
