FBN: The refusal of Dick’s Sporting Goods and Walmart to sell guns to customers under the age of 21 violates state law, according to the attorney for a 20-year-old man who is alleging in a lawsuit that the retailers discriminated against him because of his age.
“Any adult 18 to 20 is a protected class,” Max Whittington, the lawyer representing Tyler Watson, told FOX Business’ Charles Payne on “Varney & Co.”
There could be a challenge related to the Second Amendment right to bear arms if Oregon’s law changes, according to Whittington.
Some states such as Oregon, where Watson filed lawsuits against the retailers, provide protection for people 18 or older, while federal law protects those 40 or older.
While the Second Amendment could pose a legal hurdle on the federal level, these cases will need to be addressed based on statutory law, Whittington said.
“If this is ultimately changed, then there will be Second Amendment challenges,” he added. WATCH
The 20 yr old should (temporarily) “identify as gay”, and then claim that Dick’s discriminated against him due to his sexual preference. It’s Oregon and that strategery worked for the gay couple wanting a wedding cake.
Sounds like a slam dunk.

Oregon is the perfect venue for this lawsuit. They have case law with them when going against these retailers in Oregon.

I just heard from two reliable sources, wicked willy and HD, that due to their stand on guns, Ellen DeGeneres suddenly likes Dick’s. Ditto Rachel Maddow.
Interesting issue. On one hand I don’t agree with forcing a company to sell their product to anyone they don’t want to BUT Dick’s is a retailer and as such probably agreed with manufacturers/distributors to sell items according to state and federal law. Maybe Colt, Remington, etc. should sue Dick’s for breach of contract(?)
Those opposed to 18 year olds buying guns should have to go to war with 18 years olds who are issued guns.
