Supreme Court Allows Trump Admin to Enforce Deportations of Gang Members Under Alien Enemies Act

Breitbart: The Supreme Court of the United States lifted a block from U.S. District Judges James Boasberg, which prevented the Trump administration from deporting suspected illegal alien gang members under the 1798 Alien Enemies Act.

While the ruling from the Supreme Court is a win for President Donald Trump and his administration, it was described as “narrow and focused on the proper venue for the cases, rather than on the administration’s use of a centuries-old law to justify its decision” to deport suspected illegal alien gang members, according to the New York Times.

Per the outlet, in a 5-4 decision, the Supreme Court justices found that “the migrants had improperly challenged their deportations in Washington, D.C.,” when they should have challenged them in Texas, “where they were being held”:

The justices did not address the question of whether the Trump administration improperly categorized the Venezuelans as deportable under the Alien Enemies Act, finding the migrants had improperly challenged their deportations in Washington, D.C. The justices determined that the migrants should have raised challenges in Texas, where they were being held.

“The detainees are confined in Texas, so venue is improper in the District of Columbia,” the court said in its order. more here

  1. That’s a misleading headline. Teh SCOTUS decision was based simply on a geographic jurisdiction matter: wrong venue. They haven’t said anything yet about the use of Alien Enemies Act to eject gang members.

  2. It certainly appears that Judge Boasberg is a political hack, but he is based in Washington D.C. and the request for relief should have been brought in Texas. I’m pretty sure the ACLU will run down to Texas and re-file, but they may have more difficulty in finding a similarly reliable political hack.

    Instead of making the obviously sane decision – deporting illegal muderers, rapists and thieves – they allow the anti-Trump boneheads a way out…

  4. These foreigners have “migrated” illegally into this country. Migration does not define their status. It’s the illegal act of breaking US law to enter the country. On top of that, the worst of the worst illegals commit heinous crimes and terrorism while in the US.
    Very frustrating leftist, liberal and RINO Supreme Court judges insist on defining these foreign enemy combatants as “migrants”. The 1798 Alien Enemies Act was correctly applied by the Trump Administration. Enemy combatants deportation should be a federal, not a state function.
