Supreme Court Overrules Roe v. Wade in Mississippi Abortion Case

JTN: The Supreme Court on Friday strikes down the landmark 1973 Roe v. Wadecase, which for nearly half-a-century has offered a constitutional protection to a woman’s right to an abortion.

The majority opinion, issued in the Mississippi case of Dobbs v. Jackson Women’s Health, was written by Justice Samuel Alito and joined by fellow conservative Justices Neil Gorsuch, Brett Kavanaugh, Clarence Thomas and Amy Coney Barrett. 

Chief Justice John Roberts, who filed a concurring opinion, wrote that he agrees “with the Court that the viability line established by Roe and Casey should be discarded under a straightforward state decided analysis. That line never made any sense.”

The court’s final 6-3 decision overturns Roe and subsequent the 1992 Planned Parenthood v. Caseydecision, which largely upheld the initial right. 

“Roe was egregiously wrong from the start,” wrote Alito in a first draft of the now official decision that was leaked in early May. “It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.” MORE

Do these individuals still have the right to sue and appeal up to the SCOTUS for these things? I am ignorant of what the SCOTUS has previously ruled and if they are the law of the land.

  59. Justice Thomas was stating the court will not consider prenumbra decisions not founded on constitutional principles. No more cases using judicial activist derived rights out of thin air by leftist judges need apply.

    The SC will now go back to its constitutionally defined parameters, and activists asking the Justices to rule on issues outside the boundaries of constitutional precedent need not apply.

  71. The issue of abortion should be left up to elected politicians and not 5 out of 9 unelected justices who are bound to follow the Constitution in any event. That is the ruling in this case. The problem for the pro-abortion people is that is is difficult to convince elected politicians to sanction abortion in most states, and the progressives are used to using the judiciary as cover for their unconstitutional policies.

    Blue states like California, Illinois and New York will continue to sanction abortion through legislative activities. But it may be a closer question than one thinks even in those states – most politicians do not want to go on record as baby killers. Abortion has always been based on lies – when Roe v. Wade was first decided, the catch phrase was “safe, legal and rare.” Now, abortion is just another form of birth control.

    In those three cases mentioned by Justice Thomas, Griswold endorsed right to privacy, Lawrence permitted homosexual acts and Obergefell mandated that every state must recognize homosexual marriages performed in another state.

    The fourteenth amendment contains the Equal Protection clause and the Due Process clause upon which these cases were decided.

    Constitutional carry, in effect, should be in all 50 states based on the Obergefell decision. One state’s concealed carry license should be recognized in all other states based on the same reasoning of Obergefell.

  80. Wyatt — Abortion was already legal pre-Roe v. Wade, in cases of threat to a woman’s life. In Texas where Roe was hatched, abortion was legal with respect to protecting the pregnant woman’s life. I don’t know about the rape and/or incest situations. It probably varied by state — so now we have come full circle and many dead children in the meantime.

    One other reason there will be senseless violence and destruction in response to this decision is that abortion is a multi-billion dollar enterprise that reaches far beyond abortion. There is a baby parts operation to consider as well as all those who are paid to protect R v. W, look the other way and keep the enterprise solvent and growing. PP is another gov’t build-out enterprise of the spoils system just as ACORN was (is, under different names). The sheer amount of money is staggering and most of it is tax-payer paid or gained through nefarious means. That dragon will not slither back to its cave without a tremendous fight.

    Roberts, Kagan, Breyer and Sotomayor chose the wrong side on this decision and have blood on their hands. Justice Alito made reasons to overturn this injustice very clear. Justice Thomas alerted the left, conservative Supreme members need to look at the weak standing of “gay” marriage/unions. God bless them both, mightily!
    As for Kavanagh, Gorsuch and Barrett…well, proof God is in control.

    Abortion is now more difficult to obtain. Many lives are saved from enfantcide. I’m so overjoyed God has kept His Word to visit the Supreme Court to do what is right. He’ll do it again.

I was 19 and just short of 20 when Roe was decided in the middle of Jan. 1973 and had just been at NAS Miramar, Cal. for 2 weeks when I was assigned TAD duty to Special Services and was in charge of the reader boards at both gates of the base. It was also the same day that LBJ died (coincidence, I think not) because I put up the notice that LBJ had died on the reader boards at both gates of the base. Today has been a long time in coming and I am very thankful to God that Roe was overturned finally and returned to the states to decide like it should’ve been in the first place. The decision by SCOTUS today doesn’t end abortion but kicks it back to the states to decide whether or not they will allow abortion within their state borders. It’s still a win/win and most states will now decide for themselves what to do about abortion. Unfortunately, my lousy governor Jay Inslee and the other 2 ghoulish governors on the left coast have declared open season on unborn children, God help us. I’ve said before that I met Norma McCorvey while rescuing with Operation Rescue in Aug. 1996 in San Diego and I wish that she was still alive to see Roe overturned. She and we have been vindicated now that Roe is gone. And besides the original Roe decision was based and predicated on a lie concocted by the left in Harry Blackmun’s ungodly and unconstitutional decision that abortion was a constitutional right guaranteed by a so called right to privacy in the Constitution. BS, and I am extremely glad and happy to see that Roe has finally been overturned nearly 50 years after its evil and ungodly conception by the left. Praise God and Hallelujah and thank you President Trump for championing the cause of the unborn. Now I pray that the left will get their comeuppance for this 50-year nightmare they foisted on all the unborn children they have murdered and especially children of color that they created in Jan. 1973.
