A Texas federal judge on Friday ruled that Obamacare violated the Constitution, likely pushing the ruling towards the Fifth Circuit Court of Appeals.
Judge Reed O’Connor, a U.S. District Judge for the Northern District of Texas appointed by former President George W. Bush, ruled that Obamacare violated the Constitution.
Twenty Republican state attorneys general brought the suit, Texas v. Azar, who asked the court to rule that the Affordable Care Act (ACA) violates the Constitution after Republicans managed to zero out Obamacare’s individual mandate penalty with the Tax Cuts and Jobs Act last year. The judge ruled that the law’s individual mandate violates the Constitution and therefore the entire ACA violates the Constitution. MORE

It’s about time someone took the bull by the horns. This shite called AHA must be buried. Thanks to the likes of that dead splat McStain and Roberts, it lives on today. Anytime someone asks me about it, I ask them why if it is so great didn’t the federal government employees all participate in it? Instead, they exempted their staffers from having to participate as well.
Incredibly, if memory serves, there is no Severability Clause in ACA, which is unusual, so if 1 provision is struck down, the whole thing goes.
Obumblercare was designed to fail, so that we would end up with a single payer, government run health care system. Chief Justice Roberts forced this disaster on us, and now he will get to revisit his chief catastrophe. This is going to be a mighty interesting trip to the Supreme Court. Thankfully, we won’t have to depend on Roberts to decide this case. Thank you, President Trump for your two Supreme Court appointments.

I do believe you’re right, but I’m not sure that applies here. My preliminary reading of today’s decision left me with the understanding that after Congress removed the individual mandate, which was the basis for the Roberts court finding ACA constitutional strictly speaking because the mandate was a tax and thus within the authorized powers of Congress, that the remaining parts of the ACA no longer had that protection. Without the mandate, there’s no tax. Without the tax, there’s no congressional authorization.
I emphasize that I’ve only read a bit so far, so I could be mistaken.

Agree with the “albatross around our necks” take. The real “albatross” in my view is No voter ID required and in today’s abilities to be able to have enforced voter fraud. Gee, I can get turned down for a credit card in seconds, yet non-legal US citizen votes get verified before the final tally.

Also, origination. Because Ted Kennedy had did, dems did not have the votes to approve the House bill. So, under reconciliation, they allowed the House to pass the Senate bill. If, it was a tax,as defined by Roberts, that was unconstitutional as tax bills have to originate in the House.
Therefore, Roberts opinion itself was based upon a lie.
