While I appreciate the sentiment, the practical application is going to be harder than people think.
How about this? Treat as an “enhancement”, much like they do with using a gun while committing a felony ( robbing someone-10 years in prison, using a gun while in the commission of same crime, an additional 10 years enhancement).
There already exist specific crime descriptions and punishments for inciting a riot and destruction of property, charge him with these (easier to prove) then add the enhancement later.

Blindfold em and haul em out to South Eastern Oklahoma where it’s still “wild country” and turn them loose to fend for themselves. They wouldn’t make it out alive…if they do they would have a better understanding what our country is about!
