Trump vows to appoint special prosecutor to indict Hillary if he’s elected president

Newser – Amid the early fireworks of Sunday night’s debate, Donald Trump promised to appoint a special prosecutor to investigate Hillary Clinton’s email if he were elected president. “I am going to instruct my Attorney General to get a special prosecutor to look into your situation, because there has never been so many lies, so much deception, there has never been anything like it, and we’re going to have a special prosecutor,” he said, perABC News. Clinton did not directly respond to the threat but said everything Trump said was “absolutely false.” When she said it was a good thing Trump wasn’t in charge of US laws, he retorted, “Because you’d be in jail,” reports the New York Times.

  1. @PHenry…im not trying to be an asshole just have a legitimate question i dont know the answer to. Can a person be pardoned if they aren’t convicted of a crime? I think Ford pardoned Nixon when he resigned but im still not sure. Thanks!

    obama can’t pardon killery in advance of her prosecution.

    The only “trouble” Trump’s campaign was ever in was the trouble manufactured by the media with the help of the killery campaign and the #NT, including lyin’ ryan and the others who have only kinda, sorta backed Trump in order to not jeopardize their sorry asses. But when this is over and Trump is sworn in, we will turn our attention back to those who made it harder than it had to be. Guaranteed we will.

  3. If pardoned,have investigation anyway,and publish an exhaustive list of the Clintons crimes. Place proof of perfidy in congressional record. So that way for the rest of their lives and after,interviewers and historians can cite them and put the lie to any attempts to defend their legacy.

  4. @Gwenn — A president can’t ‘pardon’ someone who hasn’t been convicted of something first and killery hasn’t been convicted of anything yet. The order would be Special Prosecutor, investigation, trial and aquittal or conviction. All of that would take place after obama leaves office, so it’s impossible for him to pardon her for anything.

    There is a preemptive pardon. Ford used it to pardon Nixon. In 1866, the Supreme Court ruled in Ex parte Garland that the pardon power “extends to every offence known to the law, and may be exercised at any time after its commission, either before legal proceedings are taken, or during their pendency, or after conviction and judgment.” So, once the act has been committed, the President can issue a pardon at any time.

    There are exceptions like convictions handed down in an impeachment proceeding, Article II, Section 2 of the Constitution.

    It’s not clear if a President can pardon him or herself. Obama would.

  6. Trump should send a message: throw Comey and Lynch into that prosecution.

    All federal prosecutions should be put on hold. Focus the nation’s investigative resources into the operations of Congress (both Houses) and the Executive branches. Clean out our own house before worrying about someone else’s.

    Oh, and stop ALL immigration until this is settled. This will free up thousands of man-hours (maybe more) that can be used by investigators to pursue elected/appointed criminals in DC.
