Reagan Appointed Judge Says Constitution Has No Value- Antiquated

A federal judge appointed by President Ronald Reagan argued in a recent post on Slate that less attention should be paid to the U.S. Constitution since much of it is not relevant to the 21st century.

“I see absolutely no value to a judge of spending decades, years, months, weeks, days, hours, minutes, or seconds studying the Constitution, the history of its enactment, its amendments, and its implementation (across the centuries — well, just a little more than two centuries, and of course less for many of the amendments),” writes 7th Circuit Judge Richard Posner.

“Eighteenth-century guys, however smart, could not foresee the culture, technology, etc., of the 21st century,” he said. “Which means that the original Constitution, the Bill of Rights, and the post-Civil War amendments (including the 14th), do not speak to today.”

Conservative talk radio host Rush Limbaugh on Monday called Posner’s remarks “stunning.”

  1. He’s simply saying that the power of the gov’t should not be circumscribed, and that We, the People, are no longer sovereign, but slaves of the Established oligarchy.

  3. He may have a point. Figure the constitutional law professor we have today, Barack Hussein Obama, hasn’t bothered to spend a second, minute, hour, day, week, year, or decade to study the constitution, yet he became president just fine.

  4. That guy’s older than dirt. If he had been properly vetted before his appointment, they would have probably discovered he was a Loyalist during the American Revolution.

  5. So: Have no ideals to live up to. Conformance to the ideals of the Constitution is a problem only in that too many have not tried to live up to the ideals of the Constitution for decades. They are the punks of the power elite. Only the expedient course is followed. Follow/be the pinhead conformer. All power to the State!

  7. I read his wiki entry and he is all over the map with his opinions although he’s certainly moved leftward in the last number of years. He’s a very smart guy but to say that about the Constitution shows an incredible lack of understanding for a jurist. Time for a mandatory retirement age for judges.

  8. Aren’t these people in political offices sworn to uphold the constitution and the will of the people? Maybe I missed civics class on the day the teacher taught about it. I got a c+ in the class so what do I know. 🙂 have a good day.

  9. If he no longer believes in our Constitution, isn’t it incumbent upon him to resign? Sounds like McNamara, who no longer believed America could win the Vietnam war but was so enamored of the perks of Office that he stayed on, ensuring our defeat.

    Ok let me get this straight: Every time there is a ground breaking supreme court ruling on any issue, they quote the fourteenth and fifteenth amendments. So if we do not need the Constitution, why quote it for Supreme Court rulings? And more to the point, why do we need to have a Supreme Court in the first place? Screw it, let’s sue the gubbermint and collect damages from having to submit to said body in the first place.

    People, if Hillary gets elected, the people that will get on to that body will make life in America a living hell. A court like that will issue rulings that will make no sense at all.
