IRS Accused of Having Its Own Catch-22 Rule

The D.C. Circuit Court of Appeals has reinstated lawsuits against the IRS overturning the decision by lower courts who had thrown out the cases. At issue was whether targeted organizations were still facing discrimination by the tax agency. The IRS was unable to demonstrate that is has finally processed the applications it has been sitting on for years.

An interesting feature of the case is the three-judge panel calling out the IRS for its Catch-22 policy telling plaintiffs, “You are entitled to have your application processed. But if you ask for that processing by way of a lawsuit, then you can’t have it.”

Unfortunately, the panel did throw out an aspect of the cases which sought to sue IRS personnel for their role in the scandal.

  2. This is a discussion of one of the IRS arguments. It sounds like all the other BS they spew and expect to be accepted.

    “We would advise the IRS that a heavy burden of establishing mootness [to assist any USC graduates on this board, moot means the problem no longer exists and every one has been made whole. No reason to continue the lawsuit] is not carried by proving that the case is nearly moot, or is moot as to a “vast majority” of the parties. Their heavy burden requires that they establish cessation, not near cessation.”

They freely admit that their employees break every law in the book to shit all over average citizens and deny them their most rights, and then follow it up with a big “Fuck you.
